My partner and I separated 18 months ago and we are now selling our 所有物/資産/財産. To save on the large 早期に 返済 告発(する),告訴(する)/料金, I looked at porting the mortgage to a new 所有物/資産/財産.?
Santander has sent me an 申し込む/申し出 and everything looks 広大な/多数の/重要な. The only thing is my ex partner is now not agreeing to me porting it.

As one or both of you is moving to a new 所有物/資産/財産 then it could be possible to 避ける the cost of the ERC.?
This is referred to as porting the mortgage, and 許すs the 存在するing 条件 to be 効果的に transferred across to the new home.

Who gets the mortgage?
There's now an 追加するd incentive to 避ける coughing up an ERC, as the cost of borrowing has 増加するd 速く 予定 to 急に上がるing 利益/興味 率s.?
Porting the mortgage to a new 所有物/資産/財産 could 保存する a much lower 率 than could be 安全な・保証するd in the 現在の market 同様に as 避けるing the ERC.
That has led to some couples 交渉するing over who gets to keep the mortgage, when the 現在の 直す/買収する,八百長をするd 率 was taken at a low point and could still have a number of years left to run.
Not all 貸す人s can enable a mortgage to be 分裂(する) and ported by each of the two separating borrowers, but a number can.?
Santander is one of the 貸す人s that can 分裂(する) the mortgage, so it could be possible for you both to port it to two separate 所有物/資産/財産s.
If that is the bone of 論争 and he also wants to take advantage of the 現在の mortgage 率, it may be 価値(がある) discussing how to go about splitting the mortgage.
If the 購入(する) of a new 所有物/資産/財産 will not be 同時の, then half the mortgage would need to be redeemed which would 背負い込む a 割合 of the 刑罰,罰則.?
However, 貸す人s will often refund that ERC if a new 購入(する) is 完全にするd within a 確かな timeframe. In Santander's 事例/患者 that is within three months of redeeming.
Can you afford the home on your own??
What isn't (疑いを)晴らす is why your ex-partner isn't happy for the mortgage to be ported to a new 所有物/資産/財産.?
It would 減ずる the cost of redeeming the mortgage for both of you, and assuming that the 公正,普通株主権 is to be 分裂(する) 平等に, that would save each of you £6,000 through 避けるing the 支払い(額) of the ERC.
However, porting the mortgage to the new 所有物/資産/財産 will need the 貸す人 to be able to see that it will remain affordable.?
If you will take the mortgage on in your own 権利, you will need to 論証する that there's enough income to 会合,会う the 貸す人's affordability 基準.
However, if you're 提案するing that your partner remains on the mortgage to 含む their income for affordability 目的s, it will have consequences and may be the 推論する/理由 for their 抵抗.
Remaining on the mortgage would leave him 共同で liable for the mortgage 支払い(額)s and would 影響する/感情 the 量 that he will be able to borrow himself if he goes on to buy a new 所有物/資産/財産 in 未来.
If that hasn't already been agreed then it could be the 推論する/理由 for his 辞退するing to 許す the port in its 現在の 判型. If he needs to stay on the mortgage for you to afford the new 所有物/資産/財産, then he would be in a position to 妨げる you 訴訟/進行 with the porting.
If you are taking the mortgage on in your own 権利 it sounds like it would be in both your 利益/興味s to 避ける 支払う/賃金ing the 告発(する),告訴(する)/料金.?
You should talk to your 貸す人 about the ability to proceed to port on your own. There may be no formal 必要物/必要条件 for your partner's 同意, but the 貸す人 may be 用心深い about 訴訟/進行 if your partner has raised an 反対.
Finally, if solicitors were 伴う/関わるd in the 分離 then 協議する them on the 協定. If there was a 法廷,裁判所 order put in place, this could in theory 規定する that the mortgage be ported.
