How to を取り引きする 負債 in a 離婚: What are you still on the hook for after a marriage ends

People in 負債 can get 離婚d, but will need to agree a 計画(する) or make a formal 財政上の 解決/入植地 to 支払う/賃金 off what they 借りがある.

How this 責任/義務 is 株d will depend on whether 負債s run up during marriage are matrimonial - meaning they 利益 the couple or a family as a whole - or individual.

'When 離婚 becomes 必然的な the starting point is to 査定する/(税金などを)課す all 資産s and 負債, held both 共同で and 個々に,' says Rosalind Fitzgerald, a partner at Rayden Solicitors.

離婚s have fallen to the lowest level in 10年間s, によれば the 最新の 公式の/役人 人物/姿/数字s, although some 専門家s have 示唆するd the 増加する in the cost of living could be a factor in couples staying together.

How do DIY 離婚s work??

'No fault' 離婚 法律制定 introduced in spring 2022 has made splitting up simpler and speedier, but critics say the n ew 強調 on haste means many ex-spouses could be left worse off as a result.

Couples can now get 離婚d within six months of first 適用するing even if one partner is …に反対するd, and the 過程 is 大部分は online - 含むing the serving of 離婚 papers by email.

But 財政上の 解決/入植地s, covering both 負債s and 資産s like the family home and 年金s, are still dealt with in a separate and 平行の 過程.?

That can continue after the 離婚 is final, but lawyers advise against this - the 落し穴s are explained below.

How is 負債 divided during a 離婚?

The two types of 負債 蓄積するd during marriage which are considered during a 財政上の 解決/入植地 are as follows.

- Matrimonial 負債: This 言及するs to 資産s that have been acquired and utilised to 利益 either the couple or the family, irrespective of the 指名する under which the 負債 is 登録(する)d, says Fitzgerald.

'If it was taken for the 相互の 利益 of you, your spouse, and any children, such as a 革新 of the family home, both you and your spouse are likely to 株 責任/義務 for the 負債.

'The starting point is likely to be that this is a 株d 責任/義務, and may 井戸/弁護士席 be paid from 共同の 資産s. However, your individual circumstances, 資源s and 財政上の needs - 含むing the needs of any children of the marriage - may alter the position.'

- Individual 負債: This occurs when one spouse 背負い込むs 財政上の 義務s for their 排除的 needs, says Fitzgerald.

'Any 負債 which was 初めは brought into the marriage by one spouse will also 落ちる under this 部類, and the 責任/義務 for that 負債 will usually stay with the same individual.'

'If your 負債s are 株d, you'll both be 責任がある the whole 量 - not just your half. This means if your ex-partner stops 支払う/賃金ing the 負債 off after you separate, you'll have to settle the 負債 by yourself.

'Even if yo u and your ex-partner are talking to each other, it's a good idea to make sure you have a 計画(する) for 支払う/賃金ing off your 株d 負債s. If you're worried your ex-partner can't or won't 支払う/賃金, you should talk to a solicitor.'

What about a mortgage?

Couples are still 共同で and 個々に liable for a mortgage after the separate, によれば 法律 会社/堅い Rayden.

貸す人s will 推定する/予想する 返済s 関わりなく who they are from, although the mortgage could be 発射する/解雇するd if the 所有物/資産/財産 伴う/関わるd is sold, it explains.

国民s Advice has (警察などへの)密告,告訴(状) on what to do with a 株d home in a 関係 分裂(する), 含むing continuing to make 返済s, buying out an ex-partner and selling up.

'What you do with your home depends on what you can both afford to do once you're living 分かれて, how much value (公正,普通株主権) there is in the home and whether you have any children,' it says.

Does 離婚 影響する/感情 your credit 率ing?

'Getting 離婚d in itself will not 直接/まっすぐに 衝撃 your credit 率ing,' says Rosalind Fitzgerald of Rayden. 'However, your credit ratings will 影響する/感情 each other if you have 共同の 負債s.'

She 警告するs that the 法律 will assume that the 大多数 of 財政上の 決定/判定勝ち(する)s were made on a 共同の basis during a marriage, from having both 指名するs on 公共事業(料金)/有用性 法案s, to taking out 共同の 貸付金s, or getting a mortgage.

The 負債 charity StepChange says if you have 共同の 負債s with your partner you will need to 返す the 十分な 量 yourself if your partner cannot 支払う/賃金.

Tips on 離婚 and 負債?

負債 charity Stepchange has help and advice here. It says:

- If you are renting tell the landlord your 協定 must be put in your 指名する only;

- If you have a mortgage get 合法的な advice to help you decide what to do with the 所有物/資産/財産;

- Tell the 地元の 会議 if your partner has moved out and you are now the only adult in the 所有物/資産/財産 - you are する権利を与えるd to a 25 per cent 割引 on your 会議 税金;

- Your 利益s entitlement may change so find out what you can (人命などを)奪う,主張する.

However, on 負債s which are not 共同の you can get a 'notice of disassociation'.

'This takes any 財政上の link with your ex-partner off your credit とじ込み/提出する. 接触する one of the credit 言及/関連 機関s to 除去する this link,' it says.

How do you 保護する your 資産s during a 離婚?

Along with all 資産s and 負債s, both your and your spouse's income, 収入 capacity and 未来 income needs are 査定する/(税金などを)課すd during a 離婚, says Fitzgerald.

With this (警察などへの)密告,告訴(状), a solicitor can advise what 可能性のある 解決/入植地 選択s may be 利用できる, and any possible 維持/整備 (人命などを)奪う,主張するs.

'Your specialist family 法律 solicitor may also work と一緒に an 独立した・無所属 財政上の 助言者 or 税金 助言者 ーするために best 保護する your position,' she 追加するs.

Although you can get a 'DIY 離婚' 関わりなく whether there is 負債 or not, Rayden advises not making it final until a 財政上の 解決/入植地 has been 認可するd by the 法廷,裁判所.

'The main 推論する/理由 for this is 資産s which may 利益 a party whilst still married, such as 年金s, would be lost if the marriage has ended,' she says.?

'For example, if one party dies after the marriage has ended but before the 財政上の 解決/入植地 has been 認可するd by the 法廷,裁判所, the other party loses their status as a 未亡人 or widower. In the 状況 of 負債, one party may be 単独で liable for the 負債 に引き続いて the death of the other party.'

Getting 合法的な help in a 離婚?

It is usually best to find a lawyer 経由で a personal 推薦. You can also use the search 道具 on the 法律 Society's website - choose family and 関係s in the 減少(する)-負かす/撃墜する box and input your 場所.

If you can't afford a lawyer, you can get help with 合法的な 料金s in 確かな 状況/情勢s when you separate from a partner.
