Can my daughter keep her 10-year 直す/買収する,八百長をする mortgage after a break-up? DAVID HOLLINGWORTH REPLIES

My daughter has 分裂(する) with her partner, three years into a 10 year 直す/買収する,八百長をするd mortgage with Halifax. I have several questions about her 状況/情勢.?

1) Can she port the remaining mortgage on her own to a new 所有物/資産/財産??

2) If so, is there a time 限界 between selling the previous home and 購入(する)ing the new 所有物/資産/財産?

2) Would porting the mortgage 妨げる an 早期に 返済 告発(する),告訴(する)/料金?

3) If necessary, my husband and I will 与える/捧げる to the new mortgage but don't want to appear on the 所有権 行為s of her new 所有物/資産/財産 (thus attracting 資本/首都 伸び(る)s for us as homeowners) - is this possible??

Any help or 指導/手引 you can 申し込む/申し出 will be 高く評価する/(相場などが)上がるd. W.S.

David Hollingworth replies: It's always a difficult time when a 関係 breaks 負かす/撃墜する, and the 所有物/資産/財産 will often be a central part of the untangling of 財政上の 事件/事情/状勢s.

It makes sense to think about any changes on the horizon when considering how long to lock into a mortgage, as 早期に 返済 告発(する),告訴(する)/料金s can be 相当な.?

But that is impossible when there are unforeseen, and unforeseeable, circumstances at the heart of the need to change the mortgage - as your daughter has sadly 設立する out.?

避けるing an 早期に 返済 告発(する),告訴(する)/料金

Firstly, it is important to check the 明確な/細部 条件 of your daughter's mortgage to understand the 早期に 返済 告発(する),告訴(する)/料金s.

The 現在の 刈る of Halifax ten-year 直す/買収する,八百長をするd 率s would carry an ERC of 6 per cent in the first five years, before dropping 負かす/撃墜する by one 百分率 point each year after that to just 1 per cent in the final year.?

Porting the mortgage is the 称する,呼ぶ/期間/用語 used when an 存在するing mortgage is taken to a new 所有物/資産/財産.?That has two 可能性のある 利益s to a borrower moving home during an ERC period.?

Firstly, it could 避ける the need for some or all of the 刑罰,罰則 to be paid.?

Secondly it may be 望ましい to keep the 現在の 取引,協定 損なわれていない, as it would have been taken at a time when 利益/興味 率s were lower than they are today.

Charges: Halifax's ten year fixed rates carry an ERC of 6% in the first five years, before dropping down by one percentage point each year to just 1% in the final year

告発(する),告訴(する)/料金s: Halifax's ten year 直す/買収する,八百長をするd 率s carry an ERC of 6% in the first five years, before dropping 負かす/撃墜する by one 百分率 point each year to just 1% in the final year

Halifax 製品s are portable, and so it could be possible for your daughter to 避ける the ERC if the mortgage is taken to a new 所有物/資産/財産.?

Although some 貸す人s can 許す the mortgage to be 分裂(する) and part taken by each of the two 共同の borrowers, this wouldn't be an 選択 with Halifax.?

But assuming her ex-partner agreed not to port the mortgage themselves, your daughter could take it to her new home.

How long does she have to do this??

ーするために port a Halifax mortgage and keep the 製品 損なわれていない, the sale and 購入(する) of the new home need to be 同時の.?

That will 許す the 製品 and 率 to remain in place and 避ける any 刑罰,罰則 存在 incurred.?

True Cost Mortgage Calculator:

If the sale and 購入(する) cannot be 完全にするd at the same time, then 貸す人s will usually 告発(する),告訴(する)/料金 the ERC on redemption, but often 申し込む/申し出 a 譲歩 within a 確かな timeframe, recognising the practical difficulties of 提携させるing the タイミング.

Many 貸す人s will refund the 刑罰,罰則 that is incurred when the mortgage is repaid, if the new 所有物/資産/財産 is 購入(する)d within a 明示するd period of time.?

That could 許す a borrower to sell the 現在の home and then later buy a new 所有物/資産/財産, typically within three months, to have the ERC refunded.

Some 貸す人s will still 許す the 製品 率 to be ported within that three-month period whilst others, 含むing Halifax, may 申し込む/申し出 a refund on the ERC but 要求する a new 製品 to be taken from the 現在の 範囲.?

This may mean your daughter would have to take on the mortgage at today's 率s.??

If the 量 of the mortgage taken to the new home is いっそう少なく than the 現在の 優れた balance, then there could be a 部分的な/不平等な 返済 告発(する),告訴(する)/料金 incurred or refunded.

What are the 支配するs for porting a mortgage???

A 決定的な part of the porting 過程, whether 同時の or not, will be the need for the 貸す人's 基準 to continue to be met.?

The new 所有物/資産/財産 will have to be 許容できる to the 貸す人, but even more importantly there will be a need for the mortgage to remain affordable for your daughter.?

If she can support the mortgage based on her own income, it should 許す the mortgage to be in her 指名する only, assuming that the ex partner will be 除去するd from the mortgage.

Some 貸す人s can enable parents to be 含むd on the mortgage to 援助(する) affordability, but without 存在 指名するd on the 肩書を与える 行為s of the 所有物/資産/財産.?

This is often referred to as a '共同の borrower, 単独の proprietor' mortgage.?

This 避けるs the 関心 around 資本/首都 伸び(る)s 税金, as the 所有物/資産/財産 isn't the parents' main 住居.?

It can also help 避ける 支払う/賃金ing the 付加 率 of stamp 義務 in some circumstances, but unfortunately this 協定 isn't 利用できる through all 貸す人s and Halifax does not 申し込む/申し出 it.

If you do need to be a part-owner, you should take 合法的な 同様に as mortgage advice on the 選択s.?

You could consider structuring the 所有権 as tenants in ありふれた, with the 本体,大部分/ばら積みの of the 所有物/資産/財産 owned by your daughter.
