年金s are often neglected in 離婚 解決/入植地s にもかかわらず their value to both partners as a 共同の 資産 in a marriage.

How do new DIY 離婚s work?

Couples can now get 離婚d within six months of first 適用するing even if one partner is …に反対するd, and the 過程 is 大部分は online - 含むing the serving of 離婚 papers by email.

But f inancial 解決/入植地s covering 資産s 含むing 年金s are still dealt with in a separate and 平行の 過程, which can continue after the 離婚 is final.

'年金s are ますます a major 問題/発行する in 離婚 but for the growing number of older couples getting 離婚d 私的な 年金s are often the most 価値のある 資産 after the family home,' says lawyer Francesca Davey, of 法律 会社/堅い Nockolds.

However, she 警告するs: 'With more people 請け負うing DIY 離婚s online, the chances of making a mistake in relation to 年金s is 増加するing.?

'Couples going through 離婚 can place undue 強調 on the house and overlook the other spouse’s 年金 マリファナ.

'This can be financially 悲惨な for someone with little or no 退職 準備/条項. If a spouse has built up even a modest final salary 年金 計画/陰謀 there is a good chance that it will be 価値(がある) かなり more than the 普通の/平均(する) UK house.'

専門家s say there are three main 選択s when 取引,協定ing with 年金s in a 離婚 - 株ing them on a clean break basis, one partner (ーのために)とっておくing some of the income to be paid to an ex-spouse after 退職, and offsetting their value against other 資産s.

We look at the プロの/賛成のs and 反対/詐欺s of each below, and run through some その上の tips on what to do and how to 避ける the worst 落し穴s when dividing 年金s.

1. 年金 株ing

A 年金 is 分裂(する) into two separate マリファナs straight away on 離婚. Each ex-spouse walks away with a 株, which they 支配(する)/統制する themselves from then onwards.

This enables a clean break and 確実にするs neither of the couple is left in the worst possible position when it comes to building a 退職 income, says Sarah Coles, 長,率いる of personal at 財政上の services 会社/堅い Hargreaves Lansdown.

But she says the 反対/詐欺s are that it can be 比較して 複雑にするd, and 要求するs a 年金 株ing order from the 法廷,裁判所, which will 設立する how the 年金 should be 分裂(する).

'It may make sense to get 財政上の advice to 改善する your chances of 安全な・保証するing a fair 分裂(する). You may also need more advice if the 年金 needs to be transferred, and in 再構築するing your 退職 貯金. This will come at a cost,' says Coles.

'It leaves both partners with work to do ーするために 再構築する their 年金.'

Francesca Davey, 主要な/長/主犯 associate at Nockolds, says: 'The 利益 of a 年金 株ing order is that the 基金 is すぐに divided between the spouses, meaning the applicant knows what is going into their 年金 マリファナ now and can 計画(する) ahead.

'People need to think carefully about whether a 年金 attachment or a 年金 株ing order is the most appropriate 治療(薬).'

2. 年金 attachment order or (ーのために)とっておくing

A 百分率 of someone's 未来 年金 income and 退職 lump sum is paid to their ex-spouse when they start taking their 年金.

Coles says this enables the 年金 to be 株d, so nobody needs to start from scratch, but it needs to be ordered by the 法廷,裁判所 which comes at a cost.

'It’s not a clean break, because it’s essentially 維持/整備 paid from the 年金. All the 税金 is paid by the person taking the 年金 - even when part of the income is received by their ex,' she says.

'The person who doesn’t have the 年金 has no 支配(する)/統制する over when they receive the 利益s ? so their ex can 延期する taking it.

'They can also stop 支払う/賃金ing into that 年金 and build up 貯金 どこかよそで. And when they die, the 年金 支払い(額)s will stop to their ex.'

Davey 警告するs: 'In many 事例/患者s a 年金 attachment order may not be the most appropriate 治療(薬). This is because the order does not 妨げる a person from transferring money out of their 年金 or 強いる them to continue 支払う/賃金ing in, so unless the 年金 is already in drawdown, it can be 効果のない/無能な.

'A 年金 attachment order is risky unless the 年金 is already in drawdown and it is important to look at 正確に/まさに what 利益s the 年金 type 申し込む/申し出s to 避ける losing out by choosing the wrong 選択.'

3. 年金 offsetting

A 年金 is 保持するd by the 支えるもの/所有者 and its value is 貿易(する)d off against that of other 共同の 資産s.

'It’s a 比較して straightforward way to 安全な・保証する a clean break,' says Coles. 'It can enable one half of the couple to remain in the family home.'

But she 追加するs: 'Whoever 貿易(する)s away their 権利 to a 年金 will have a mountain to climb when it comes to building a decent income for 退職.'

What else should you consider? 地域の differences?

'What can be divided depends on where in the UK you are 離婚ing,' says Menna Cule, 長,率いる of the Birmingham office at wealth 経営者/支配人 RBC Brewin イルカ.

'In England, むちの跡s and Northern Ireland the total value of the 年金s you have each built up is taken into account, 除外するing the basic 明言する/公表する 年金.

'In Scotland, only the value of the 年金s you have both built up during your marriage or civil 共同 is considered. 普通は, anything built up before you married or after your "date of 分離" does not count.'

Do you need 財政上の advice

Not understanding the value of what you have is a 罠(にかける) for people splitting up, says Coles.

'There are a few 選択s to consider, so you need to be 確かな you choose the best one for your circumstances.'

Ben Glassman, a partner and the 長,率いる of family and 離婚 at wealth 経営者/支配人 Evelyn Partners, says it's important to get 財政上の 同様に as 合法的な advice at the 手始め, not wait until after a 離婚 解決/入植地 is agreed.

'The 離婚 過程 can be confrontational but also nuanced. There are many 適切な時期s for 衝突, 不信 and 誤解 and so it is important to have the 権利 team supporting each party.

'In particular, the gut reaction is often to hang on to the family home, but this may not always make 財政上の sense, 特に when there are other sizeable 資産s to consider such as 年金s.'

Have you thought about 税金?

Couples who 分裂(する) up 資産s and will be on separate incomes after a 離婚 should consider the 税金 consequences, and whether they need help from an accountant, 財政上の 助言者 or planner.

'It’s important to 得る a 発射/推定, 特に when looking to equalise the 年金 entitlement of the two spouses.’

Keep your 表現 of wish forms with your 年金 計画/陰謀s updated, says Helen Morrissey, 長,率いる of 退職 分析 at Hargreaves Lansdown.

'You will have filled out an e xpression of wish form to say who you would like to receive your death 利益s when you started your 年金.

'However, this may have been a long time ago and in the 合間, you may have 離婚d, separated or started a new 関係 and so the person 指名するd on the forms may not be the person you want to 利益.

'While 行政官/管理者s/trustees may have discretion in some 事例/患者s to award death 利益s to someone other than who is 指名するd on the form, いつかs they don’t. It’s best to make sure these are updated 定期的に to make sure your wishes are considered should the worst happen.'

Still married and hoping you will never get a 離婚?

Couples who make 決定/判定勝ち(する)s about 年金 saving together are more likely to have a richer 退職.
