The 抱擁する 法案 results from a 失敗 to 増加する some women's 支払い(額)s when their husbands reached 明言する/公表する 年金 age or died, or when they themselves reached the age of 80.

Many women are understandably asking if they lost out on thousands of 続けざまに猛撃するs, and we explain how to find out and what to do below.?

Who is 影響する/感情d by the 失敗?

Married women who retired on small 明言する/公表する 年金s before April 2016 should get an uplift to 60 per cent of their husband's basic 明言する/公表する 年金 支払い(額)s once he reaches 退職 age too, but some have 行方不明になるd out.

Since 2008, the 増加するs are supposed to be (a)自動的な/(n)自動拳銃, but before that women had to 適用する to get the 十分な sum they were 予定.

Some 未亡人s can also 相続する large sums in basic and second 明言する/公表する 年金 from their late husbands, but this depends on their ages and the strength of their late spouse's 国家の 保険 記録,記録的な/記録する.

Over-80s who are 居住(者) in the UK should also be getting a '部類 D' 年金 of £80.45 a week.

The Department for Work and 年金s has 確認するd that 死んだ women who were underpaid will have arrears paid to their 広い地所, so it will go to their 受益者s.

The above groups should be 接触するd by the DWP 結局 as part of a ‘是正 演習’.

However, some 離婚d women may also have 行方不明になるd out, and women whose husbands reached 明言する/公表する 年金 age before 17 March 2008, and they will need to make proactive (人命などを)奪う,主張するs to the DWP.??

What was the error 原因(となる)ing women to be underpaid 明言する/公表する 年金?

An 概算の 170,000 年輩の women have lost money over many years 予定 to the DWP failing to make 増加するs in their 明言する/公表する 年金.

This is 存在 非難するd on junior civil servants not manually updating 記録,記録的な/記録するs 適切に over several 10年間s.

Many women who rang up to question why their 明言する/公表する 年金s were so low were fobbed off, いつかs 繰り返して, by DWP staff over the years.?

And the 事例/患者s where problems were discovered and 是正s made don't appear to have rung alarm bells at the DWP, until This is Money began publishing stories about women receiving backpayments of thousands of 続けざまに猛撃するs.

This 誘発するd a 急ぐ of calls from women asking for their 明言する/公表する 年金s to be reviewed from 早期に 2020 onw ards. The DWP looked into the 問題/発行する, and 発表するd its '是正 演習' to 確実にする women receive what they are 借りがあるd.

The most 最近の arrears 見積(る) given by the 政府 is vastly bigger than an 初めの 見積(る) of £100million by Webb, who is now a partner at 年金s 顧問 LCP. He based that 人物/姿/数字 on a Freedom of (警察などへの)密告,告訴(状) request made to the DWP in 早期に 2020.?

However, the DWP has 改訂するd it several times and the final 人物/姿/数字 is still uncertain.

How can you tell if you were underpaid 明言する/公表する 年金?

Under its '是正 演習', the DWP will be 接触するing some women proactively, but this could take years.

The DWP has 確認するd that 死んだ women who were underpaid will have arrears paid to their 広い地所, so it will go to their 受益者s.

What if you are only given a one-year backpayment?

While some women are getting 十分な arrears from the DWP, others are only receiving a one-year backpayment and an 増加するd 明言する/公表する 年金 going 今後 - all depending on when they and their husbands were born.

As explained above, married women who retired on small 明言する/公表する 年金s before April 2016 should get an uplift to 60 per cent of their husband's 支払い(額)s once he reaches 退職 age too.

Since 17 March 2008, the 増加するs are supposed to be (a)自動的な/(n)自動拳銃, so women with husbands retiring since then get a 十分な backpayment.

But before that women had to make a (人命などを)奪う,主張する to get the 十分な sum they were 予定, so they get a much smaller payout.

The 重要な date of birth for husbands is 17 March 1943.

The 政府 was meant to 令状 to the couples 影響する/感情d before March 2008 and ask them to 適用する for an 増加する.

But all the women This is Money have spoken to who 行方不明になるd out are 毅然とした neither they nor their husbands received such a letter, and 主張する they would have 行為/法令/行動するd on it if they had done so.

The DWP says that in 事例/患者s where a one-year backpayment is 予定, it 受託するs the first letter or telephone communication from a 顧客 querying their 明言する/公表する 年金 entitlement as the valid date of (人命などを)奪う,主張する.

It then 決定するs the 12-month backdating arrears period based on this (人命などを)奪う,主張する date.

In other words, this means women should not be left out of pocket for the その後の time the DWP takes to 過程 their (人命などを)奪う,主張する.

But it would be sensible to keep a 記録,記録的な/記録する of the first date you phone up or a copy of your 初期の letter so you can 証明する it if necessary.

One woman has 首尾よく complained about maladministration by the Department for Work and 年金s and got a 十分な backpayment 加える 利益/興味 and 補償(金).?

There are also four '(法などの)抜け穴s' that we know of where women with 'pre-March 2008 事例/患者s' might receive a bigger payout.

1. Date of birth: It depends on whether you reach 明言する/公表する 年金 age before or after your husband, 同様に as his date of birth.

If your husband reached 明言する/公表する 年金 age before 17 March 2008, and you did so after him - even if your 明言する/公表する 年金 age also fell before that 重要な date - you still get 十分な arrears

This is because the DWP should have taken account of your husband's 明言する/公表する 年金 status, and automatically 増加するd your 明言する/公表する 年金 in line with it when you started receiving your 支払い(額)s too.

2. Deferment: If your husband deferred his 明言する/公表する 年金 before 17 March 2008 and began taking it afterwards, you can receive a payout 支援する to the date he ended the deferment.?

If you have already received only a one-year backpayment, and your husband’s deferment was not taken into account, you should get 支援する in touch with the DWP and ask for another review.?

3. (民事の)告訴: Many women raised the 問題/発行する of their low 明言する/公表する 年金 with the DWP over the years. If it has a 記録,記録的な/記録する of this, or you can 証明する it somehow, your payout could be backdated to this point.

4. 無 basic 明言する/公表する 年金:?Around 5,000 women in the UK receive ‘卒業生(する)d 退職 利益’, earned between 1961 and 1975, and translating to just over £1 a week in 明言する/公表する 年金 today.

They receive 無 basic 明言する/公表する 年金 年金, because of a 支配する which 要求するd a 25 per cent 出資/貢献 記録,記録的な/記録する before any was 予定.

As they never received basic 明言する/公表する 年金, they also didn't (人命などを)奪う,主張する on their husband's 記録,記録的な/記録する when he reached 明言する/公表する 年金 age.

The women on tiny 卒業生(する)d-only 支払い(額)s are technically regarded as having 'deferred' their basic 明言する/公表する 年金, so they will get 十分な arrears even if their husbands retired earlier than March 2008.?

However, as with other married women 影響する/感情d by the スキャンダル, those whose husbands retired before that 重要な date have to proactively 接触する the DWP - even though they stand to lose a lot more.

Webb says 宝くじ-sized payouts could be 伴う/関わるd in such 事例/患者s.??

'It is very important that women on these very small 年金s make 接触する with the DWP as soon as possible to see if they could be する権利を与えるd to a windfall,' he says.?

Can you 控訴,上告 against a one-year backpayment?

Many 年輩の women who only received a one-year backpayment are 戦う/戦いing with the 政府 for 十分な arrears, but were dealt a bitter blow by the 議会の Ombudsman.

The (民事の)告訴s 団体/死体 has told women it will not 介入する in the 政府's 決定/判定勝ち(する) to only 手渡す them a one-year 支払い(額).

They 含む Audrey Watson, whose husband Brian wrote to Steve Webb a year ago, 誘発するing the 調査 which has 利益d many other women.?

Webb had 以前 written to the Ombudsman asking it to look at whether the DWP was 有罪の of maladministration, and to find a way to put things 権利.

After it 発表するd it would not step in, he said: 'I will be making the strongest possible 代表s to the Ombudsman to think again about this 決定/判定勝ち(する).'

You can still complain to the DWP and there are two ways to challenge it on this 問題/発行する.?

?- 控訴,上告: Argue that the 法律 has been 適用するd incorrectly; if the DWP 拒絶するs this, as it has in all 事例/患者s we know of so far, you can ask for a '義務的な reconsideration' of your (民事の)告訴, followed by a 法廷.

However, as every 控訴,上告 we know of has been 不成功の, you might have more chance if you complain about maladministration?

- Complain about maladministration: This is about how the DWP ran the system; you should complain first to the DWP - give as much 詳細(に述べる) as possible, 含むing that 重要な 文書s were sent to husbands - then to an 独立した・無所属 事例/患者 Examiner, then to the 議会の Ombudsman.

In all 事例/患者s, it is 価値(がある) asking your MP to 圧力(をかける) your 原因(となる) with the DWP 同様に.?

If you go to the 議会の Ombudsman, your MP will have to 調印する your form as part of the 過程.?

If you have already gone to the Ombudsman, and were recently 知らせるd of its 決定/判定勝ち(する) not to 介入する in backpayments, you can go 支援する to your MP and ask for their support in getting the Ombudsman to 再考する.

What if you believe a 死んだ parent was underpaid?

It is 恐れるd that many 年輩の women must have died while unwittingly 借りがあるd 広大な sums by the 政府.

We have received many enquiries from (死が)奪い去るd adult children about their late parents' 明言する/公表する 年金s.

Two (死が)奪い去るd daughters have already received sums of £42,000 and £71,000 because their mothers were underpaid 明言する/公表する 年金 for more than a 10年間 before dying in their nineties. Read their stories?here.

However, the DWP does not know how many pensioners have died while unwittingly 存在 underpaid, as it 普通は destroys 記録,記録的な/記録するs four years after the death of a pensioner and their 生き残るing spouse,?によれば a 国家の Audit Office 報告(する)/憶測 into its 失敗s.?

What if you are 離婚d??

Some older 離婚d women may also be losing out, and we covered the 事例/患者 of a 77-year-old retired shopowner who received a shock £60,000 here.

Webb identifies two groups of 離婚d women who are most likely be 行方不明の out.

1. Women who were 離婚d at the point of 退職

'Those who are 離婚d when they reach 年金 age can ask DWP to '代用品,人' the NI 記録,記録的な/記録する of their ex-husband up to the date of the 離婚,' he says.

'Those who 離婚 later in life are therefore 特に likely to 利益 as they can 代用品,人 their ex-husband's 記録,記録的な/記録する for a longer period of time.'

2. Women who 離婚d after 退職 but have never 通知するd the DWP

These women can have their basic 明言する/公表する 年金 再評価するd using their ex husband's 出資/貢献s, but they must 通知する DWP of their 'change of circumstances', says Webb.

明言する/公表する 年金 支払い(額)s to 離婚d women do not 影響する/感情 the 量s received by their ex-husbands.

Should a husband have a worse 国家の 保険 記録,記録的な/記録する than his ex-wife, he could (人命などを)奪う,主張する a higher 明言する/公表する 年金 on that basis too.

What about 利益/興味 for the years you were underpaid?

The DWP has 発表するd that it has 中止するd giving 'special 支払い(額)s' or 利益/興味 to women paid incorrectly.

This is because the DWP now classes this as a '是正 演習' - however, no money will be clawed 支援する from those who have already received it.

The 削減(する)-off date is January 11 2021, so if you 接触するd the DWP before then you may still get 利益/興味 on the money you were underpaid over the years, and it is 価値(がある) asking if you do not.

以前, This is Money understood the DWP was deciding 利益/興味 支払い(額)s based on whether a woman was underpaid for more than a year, whether it was 負かす/撃墜する to 政府 error and whether 利益/興味 would 量 to £10 加える. However, it never 確認するd the 基準 to us.?

Will you have to 支払う/賃金 所得税 on any backpayment??

We have 報告(する)/憶測d on many 事例/患者s of women who are 普通は on too low an income to 支払う/賃金 税金, but whose 抱擁する backpayments will 押し進める them into a higher 所得税 bracket?in the 税金 year they receive it.?

After the 労働 Party asked the 財務省 about this, it 明らかにするd that women will only be 税金d as they would have been if paid 明言する/公表する 年金 正確に at the 権利 time, and only then in the 現在の 税金 year and for the previous four years.?

'所得税 is calculated on arrears of 明言する/公表する 年金 for the 税金 year in which the pensioner was する権利を与えるd to receive it, and not in the year in which a lump sum is paid,' it said.

'Where arrears of 明言する/公表する 年金 are paid, 所得税 will only be 予定 on any income that 越えるs the personal allowance for the 各々の 税金 year.

'In 新規加入, HM 歳入 and Customs can only collect 所得税 for the 現在の 税金 year and the four 先行する 税金 years. Any arrears of 明言する/公表する 年金 relating to earlier years will not be 支配する to 所得税.'

What does the DWP say?

A DWP spokesperson said: 'We are fully committed to 確実にするing the historical errors that have been made by 連続する 政府s are 訂正するd.
