I'm a painter and decorator and in the spring and summer of 2023, I did some work for 王室の Life, an 操作者 of bungalow コンビナート/複合体s and holiday homes.

I was paid in part, but am still 借りがあるd £4,500. すぐに after my work finished, the company went into 行政.?

I spoke to the 行政官/管理者s but they said I didn't have a (人命などを)奪う,主張する because I invoiced for my work before the company went into 行政.

Is there any way I can still get my money?

Helen Crane of This is Money replies: I am sorry to hear you are 借りがあるd so much money.?You told me that the sum of £4,500 is 'a fortune' for you as a 単独の 仲買人. Essentially, it means that you worked for several weeks without 支払う/賃金.

The 王室の Life 行政, which was 宣言するd in August 2023 because the 会社/堅い was unable to 支払う/賃金 its £308million 負債s, 特に sticks in the craw for you because of the public persona of the 会社/堅い's former director, Robert Bull.

A larger-than-life character known as '(頭が)ひょいと動く the 建設業者,' he made his fortune by transforming static caravan parks into bungalow villages for people who 手配中の,お尋ね者 to downsize. He built up this 商売/仕事 に引き続いて a previous 破産 in 2016.?

'The 目的 of their 任命 is to try to save the company from insolvency. If that is not possible, they will 勝利,勝つd the company up - in other words, sell its 資産s and 支払う/賃金 creditors.

'Most 行政s result in a 勝利,勝つd-up in the long run. 行政官/管理者s continue 貿易(する)ing the company for a 確かな period in the hope of 達成するing a higher return on the company 資産s than if they were sold straight away. Thi s is for the 利益 of all creditors.'

王室の's 行政官/管理者s are a 会社/堅い called James Kowper Kreston, which was 任命するd on 15 August 2023.

A 買い手 has not been 設立する for the company, and the 行政官/管理者s have now sold the 会社/堅い's main 資産s, its 大臣の地位 of 35 bungalow parks across the UK.

In January of this year, they were acquired by a company called 外交官/大使 Regency Group for an 公表されていない sum of money.

That will have been a 救済 for 居住(者)s living on former 王室の Life parks, and the staff who work on them, as it means the 場所/位置s will continue to operate.

But for 王室の's creditors, 含むing small 商売/仕事s such as yourself, there are still doub ts about whether they will get their money.

While money was made from the sale of the 場所/位置s, 王室の had 負債s totalling £308million when it went into 行政 - and under the insolvency 支配するs, these must be paid off first.

As Campbell-Adams explains: '安全な・保証するd creditors (who entered into 確かな 協定s) are する権利を与えるd to be paid first when a company is 負傷させる up. Mortgages are a prime example.

'There are also preference creditors, such as company 従業員s, who get paid after 安全な・保証するd creditors. 供給者s who are 借りがあるd money for goods and services are unsecured creditors and get paid last.

Sadly, this means that 単独の 仲買人s such as yourself often get a raw 取引,協定.

Unsecured creditors should still be able to make a (人命などを)奪う,主張する with the 行政官/管理者s, though. This means that, once the 安全な・保証するd and preference creditors have been paid, they could be able to get a 株 of what is left over.

The big caveat here is that there is いつかs no money left over. Companies go into 行政 because they are unable to 支払う/賃金 their 負債s, and while 行政官/管理者s do their best to raise 付加 基金s through selling 資産s, it is rarely enough to give everyone 伴う/関わるd what they are 借りがあるd.

You say that you were told you couldn't make a (人命などを)奪う,主張する with the 行政官/管理者s because you invoiced 王室の before 15 August 2023.

I believe there was a miscommunication here. What I think the 会社/堅い was 現実に telling y ou was that £4,500 invoice couldn't be considered for 支払い(額) 権利 away, and that you would need to wait until the 訂正する point in the 行政 過程 was reached.

Campbell-Adams 追加するs: 'Whilst they are running the company, 行政官/管理者s can enter the company into 契約s with third parties, which is why 王室の Life can still 支払う/賃金 for goods and services after 15 August 2023.

'However, as soon as a company is placed into 行政, creditors are 妨げるd from 追求するing 合法的な 訴訟/進行s against the company.?

'This is known as a statutory 支払い猶予/一時停止 period. Companies that become creditors after 行政官/管理者s are 任命するd can still bring a (人命などを)奪う,主張する because the 負債 is the 行政官/管理者s' doing.'

You have learned that 請負業者s working on 王室の 場所/位置s at the moment are 存在 paid, while you are still waiting for your money. That is because they were 任命するd by the 行政官/管理者s, and not by 王室の.

You told me you think that is 高度に 不公平な, and given your 状況/情勢 I can see why you feel that way.

'The 行政官/管理者s have told me they won't 支払う/賃金 me because I invoiced them before they got 伴う/関わるd, to me that shouldn't 事柄,' you said in your email to me. 'Because I'm a 単独の 仲買人 they think they can just fob me off but I'm 決定するd to get my money.'

Unfortunately, the 行政官/管理者s don't have a choice in this 事柄. As the 負債 was incurred on 王室の's watch, before the 行政官/管理者s became the company's directors, they don't have the 合法的な 当局 to 支払う/賃金 you 権利 now.

The (人命などを)奪う,主張するs of all creditors can only be considered once the company is 負傷させる up and the 行政官/管理者s know how much money, if any, is left in the マリファナ.?

To 支払う/賃金 you now would be 不公平な on all the others like yourself who are also waiting to see if they can get their cash.

You could ask the 法廷,裁判所 for 許可 to begin 合法的な 訴訟/進行s against 王室の, but this would be expensive - probably costing more than the £4,500 you are 借りがあるd. 許可 would also likely be 否定するd, によれば Campbell-Adams.?

'A company enters 行政 because it does not have enough money to 支払う/賃金 all of its creditors, she says. 'Therefore, the 法廷,裁判所 needs to consider the 利益/興味 of all creditors so 許すing one creditor to 告訴する would be 不公平な on the others.'

Sadly, your only 選択 is to wait until the company is 負傷させる 負かす/撃墜する and see what, if any, money is left for unsecured creditors.

Says Campbell-Adams: 'The best 選択 is to 服従させる/提出する the 詳細(に述べる)s of his (人命などを)奪う,主張する to the 行政官/管理者 (known as proof of 負債) and ask if it is 受託するd his company is an unsecured creditor.

'If they 受託する this, then he should ask for periodic updates and check in with the 行政官/管理者s. He could 追求する a (人命などを)奪う,主張する against the company after 12 months if the 行政官/管理者 中止するs 事実上の/代理 and has not 延長するd their 指示/教授/教育. This is very rare in practice.'

I 接触するd 王室の's 行政官/管理者s, James Kowper Kreston, to ask whether unsecured creditors like yourself would be likely to get any of the money they are 借りがあるd - and I am sorry to say it was not good news.

They told me that, in the 事例/患者 of 王室の Life, it was very ありそうもない that any meaningful 量 of money would be left over for unsecured creditors at all.

However, the 会社/堅い 示唆するd that you 服従させる/提出する a form on its website, so that you would receive updates about the 行政, and be 通知するd if the 状況/情勢 changed.

I understand that this is a disappointing 結果 for you.?
