NAZIR AFZAL: There HAS to be a 犯罪の 調査 into the BBC's Princess Diana interview

The police cannot 持つ／拘留する 支援する any longer. There has to be a 犯罪の 調査 into how ツバメ Bashir 得るd his interview with Princess Diana and the 明らかな BBC cover-up that followed.

The excoriating language used by Lord Dyson in his findings is uncompromising and 高度に unusual for a former 最高の 法廷，裁判所 裁判官.

This, 連合させるd with the 需要・要求する for a police 調査（する） by Diana’s brother, Earl Spencer, and 司法（官） 長官 Robert Buckland’s 関心s over the ‘very serious 問題／発行するs’ raised, leaves no room for その上の 延期する or prevarication.

What has to be decided now is which 告発（する），告訴（する）／料金s should be considered. Any historical 罪，犯罪 can only be 起訴するd under 法律s that 存在するd at the time. It is not 十分な that they would qualify as offences now, under 現在の 法律制定.

法律制定 around 詐欺 was 貧しく defined in the Nineties, which is why the 詐欺 行為／法令／行動する of 2006 was brought in. But the 法律s 利用できる in 1995 せねばならない be 十分な for considering a 一連の 告発（する），告訴（する）／料金s.

The simplest and easiest would be an 主張 of 偽造 under the 1981 行為／法令／行動する. To be successful, all the 起訴 need do is show that Bashir used ‘an 器具’ that he knew to be (1)偽造する／(2)徐々に進むd.

On any basis of what he has already 認める to the BBC and to Dyson, he 明確に arranged for the 偽造 of 文書s, 含むing a bank 声明, which were shown to Earl Spencer.

The other 可能性のある 告発（する），告訴（する）／料金 would be that Bashir 得るd a pecuniary advantage by deception, a 罪，犯罪 under the 1968 窃盗 行為／法令／行動する. ‘Pecuniary advantage’ means he 伸び（る）d financially ? not 直接／まっすぐに from the princess, who of course did not 支払う／賃金 him, but as a result of the interview.

There is an even more serious 可能性, that Bashir committed 共謀 to defraud the public purse

There is no 疑問 in my mind that Bashir did 利益, very 大幅に. Not only did he collect a number of prestigious awards, 含むing a Bafta, but his success led to other scoops, 含むing the Michael Jackson interview in 2003. Its first broadcast was watched by 38million people in the US alone. That led to lucrative 職業s with major American channels 含むing NBC and ABC.

All this is damning. But there is an even more serious 可能性, that Bashir committed 共謀 to defraud the public purse. He was 存在 paid by the BBC, and thus by the ordinary licence 料金 payers. He took public money and, it could very 井戸／弁護士席 be argued, used it to commit a 罪，犯罪.

This is a ありふれた 法律 offence that carries a 最大限 宣告，判決 of ten years in 刑務所，拘置所. To 証明する the 告発（する），告訴（する）／料金, it would have to be shown that he made an 協定 with other people to carry out the 詐欺. I have not seen conclusive 証拠 of this in the Dyson 報告（する）／憶測.

But he 明確に was not 事実上の／代理 alone. There may 井戸／弁護士席 be others who were 上級の BBC 従業員s at the time who should also be 調査／捜査するd for 共謀. This goes to the heart of the 事柄. Bashir’s 申し立てられた／疑わしい 罪，犯罪s must be 調査／捜査するd, but the BBC cannot be 許すd to use him as a scapegoat.

Even more 潜在的に serious than his deceptions 事前の to the Diana interview are the 活動／戦闘s of BBC bosses that followed. A 告発（する），告訴（する）／料金 of 不品行／姦通 in public office has never been 実験（する）d in the 法廷，裁判所s against a BBC 従業員.

A ありふれた 法律 offence that carries a 最大限 life 宣告，判決, it can be invoked where people with public 義務s, from 会議 公式の／役人s to police officers, are 伴う／関わるd.

上級の (n)役員／(a)執行力のあるs of the BBC are certainly paid from the public purse, and they certainly have a 義務 to the public. Tony Hall, who was 長，率いる of news and 現在の 事件／事情／状勢s at the time and later became director-general, held 上級の 地位，任命するs in a 公然と 基金d 団体／死体.

A 事例／患者 could be argued, without question, for considering a 告発（する），告訴（する）／料金 of 不品行／姦通 in public office.

BBC (n)役員／(a)執行力のあるs 耐える 犯罪の 義務／負債 if they knowingly ignored Bashir’s dishonesty. It might also be said that they committed 共謀 to pervert the course of 司法（官）, a very serious offence that once again carries a possible life 宣告，判決.

The public has a 権利 to 推定する／予想する 上級の public 人物／姿／数字s to 行為／法令／行動する with 予定 diligence ? to do their 職業s competently, in other words.

When the BBC 調査（する）d Bashir’s methods, they 受託するd his protestations of innocence and failed to dig deeper ? for example, by asking Earl Spencer for his 見解／翻訳／版 of events.

Whether Lord Hall and his team were 簡単に naive, or whether they 活発に decided not to ask ぎこちない questions, they were remiss either way. It was ありふれた sense that they should not have 受託するd Bashir’s defence at 額面価格, and 怠慢，過失 when they did.

I struggle to see why the 主要都市の Police did not 開始する an 調査 when Earl Spencer wrote to Dame Cressida 刑事, the Met commissioner, last January.

It may be they decided, with Bashir unwell に引き続いて heart problems, that 起訴するing a sick man was not in the public 利益／興味. But it is the 義務 of 検察官，検事s to 行為／法令／行動する without 恐れる or favour. If the people in 力／強力にする turn a blind 注目する，もくろむ to 罪，犯罪, other people will feel encouraged to commit it.

The Dyson 報告（する）／憶測 points to 重要な failings at the BBC in 1995, before the Diana interview ? and still worse failings in 1996, with the 明らかな cover-up.

The fact t hat nothing has been done for 25 years leaves us with even more questions now.

ツバメ Bashir broke his silence yesterday to （人命などを）奪う，主張する he ‘loved’ Princess Diana and brazenly 主張するd it was ‘不当な and 不公平な’ to 非難する him for her death.

The 不名誉d former BBC reporter 認める he was ‘wrong’ to show Diana’s brother, Earl Spencer, (1)偽造する／(2)徐々に進むd bank 声明s ahead of his 目印 Panorama interview with her in 1995.

But he 強調する／ストレスd: ‘It had no 耐えるing on [Diana], it had no 耐えるing on the interview.’ Bashir, 58, was speaking out for the first time since former 裁判官 Lord Dyson savaged him in a 報告（する）／憶測 last week for the ‘deceitful and dishonest’ 策略 he used to 伸び（る） 接近 to the princess.

陳謝 to princes...

He told Diana’s sons William and Harry he was ‘深く，強烈に sorry’ and said the princes are in his thoughts, 追加するing: ‘I can’t imagine what their family must feel each day.’

...But not for Diana

My family and I loved her,’ he told the Sunday Times. The rogue reporter defended the interview by 持続するing that Diana was happy with the programme and the pair had remained friends.

He showed off a letter from the princess, written on November 21, 1995 ? the day after it was broadcast ? in which she said: ‘Thank you, ツバメ, for listening to me, for supporting me and for understanding this particular lady.’

We were friends

The once-celebrated reporter 主張するd he was such good friends with Diana that she visited St George’s Hospital in south London after his wife Deborah gave birth to their third child, Eliza, in March 1996. Bashir brandished photos of the occasion and 追加するd: ‘We were friends. She was みごたえのある.

‘She said to me: “You must let me know the moment the baby arrives” and, an hour later, there was a knock on the 配達／演説／出産 room and in she walked.’

He also showed off another letter in which Diana 招待するd the couple on holiday to Scotland after Deborah developed pleurisy. He told how he and Diana 社債d over a programme he had made about 地位，任命する-誕生の 不景気, which his wife had 苦しむd from.

Bashir said: ‘Diana talked about her own experience of 地位，任命する-誕生の 不景気. She spoke about bulimia a bit.

‘She also said something like ? and this is hard to 解任する and I didn’t take 公式文書，認めるs ? she said something about feeling suicidal.’

Bashir, who landed lucrative jo bs in the US after his Diana scoop and bought a £1.9million London home with cash, 主張するd he had never 利益（をあげる）d financially from his 関係 with the princess.

The reporter also 拒絶するd （人命などを）奪う，主張するs by Earl Spencer, who last week linked his sister’s death in a Paris car 衝突，墜落 in 1997 to the interview.

He said: ‘I don’t feel I can be held 責任がある many of the other things that were going on in her life and the コンビナート／複合体 問題／発行するs surrounding those 決定／判定勝ち（する）s.

‘I can understand the 動機づけ [of Earl Spencer’s comments], but to channel the 悲劇, the difficult 関係 between the 王室の Family and the マスコミ 純粋に on to my shoulders feels a little 不当な...The suggestion I am singularly responsible, I think, is 不当な and 不公平な.’

Bashir also （人命などを）奪う，主張するd Diana’s 関係 with Earl Spencer was ‘very difficult’.

He said: ‘公正に／かなり soon after we met, she didn’t want me to communicate with him. She felt he would 漏れる 詳細（に述べる）s of the interview and stuff, and felt that he wasn’t 信頼できる.’

The BBC’s former 宗教 editor 持続するs that he 現在のd the 文書s only after he had been introduced to Diana.

He said: ‘明白に, I 悔いる it ? it was wrong.

‘But it had no 耐えるing on anything. It had no 耐えるing on [Diana], it had no 耐えるing on the interview.’

He said Diana had no hesitations about the programme and, in fact, was 関心d that the Palace would try to stop it.

Bashir said he wished people would 焦点（を合わせる） on how ‘開拓するing’ the princess was to speak about mental health and infidelity rather than the スキャンダル over how he got her to sit 負かす／撃墜する with him for the Panorama interview. After it 空気／公表するd, the pop legend complained he felt he had been tricked by Bashir. Taj Jackso n ? son of Michael Jackson’s older brother Tito ? said yesterday that the film 与える／捧げるd to his uncle’s death in 2009. He said Bashir used ‘manipulated （映画の）フィート数’ and ‘unethical’ practices in the 文書の.

Tito, 67, 追加するd: ‘He used Michael’s 信用 and friendship with Diana to get the interview, manipulated Michael throughout the interview, then deceptively edited the （映画の）フィート数.’

A maternity nurse, who was at the centre of a surrogacy story, told how Bashir even アイロンをかけるd her 着せる／賦与するs in a 企て，努力，提案 to 勝利，勝つ her 信用 and 説得する her to appear on Panorama. Karen Roche-Pearson, who had agreed to be a surrogate but then kept the baby, said he 納得させるd her to appear on a 1997 programme by 約束ing that she would be portrayed as a 犠牲者.

The 55-year-old mother, from Beverley, East Yorkshire, told the Sunday Mirror: ‘I met him three times when he （機の）カム to do Panorama. He was such a creep and would pretend to be nice by doing my アイロンをかけるing. He’d say, “Oh, let me do that for you”.

‘But the show wasn’t what he said it was going to be. It was supposed to be on my 味方する.’ She said she felt he ‘全く lied’, 追加するing: ‘I wa s a really big fan of Princess Diana and he was 説 to me, “I did the famous Diana interview”. He was using it to 説得する me.’
