BARONESS NICHOLSON: Why I 恐れる the sanctity of 選び出す/独身 sex 区s is under 脅し from trans 権利s

A hospital should be a 避難 ― somewhere that ill and 攻撃を受けやすい people can stay in 絶対の safety, their only 関心 存在 to 焦点(を合わせる) on getting better.

But, sadly, I have come to learn these 会・原則s can at times 逸脱する far from this ideal.

For 井戸/弁護士席 over a year now, people working across the NHS have been 令状ing to me to tell of their 深い 関心s about a 悲劇の and, I believe, dangerous 転換 that has taken place inside our hospitals.

The consequences of this change were foreseeable ― but are no いっそう少なく horrifying.

In my capacity as 議長,司会を務める of the 議会の (選挙などの)運動をする group Children and Women First, I have been reading of the most appalling 性の behaviour 申し立てられた/疑わしい by whistleblowers to have taken place on hospital 前提s, 含むing at least one 事例/患者 of 強姦.?

Though the accounts are unproven at this 行う/開催する/段階, they are serious enough to be 高度に worrying.

And what has made this possible?

Without 協議 ― and in my opinion, in 反抗 of the 法律 ― NHS 信用s across the country have 問題/発行するd 指導/手引 説 患者s should be 融通するd based on the gender they say they identify with.?

This means they can 選ぶ which 区, 洗面所s and にわか雨 施設s they use.

As a result, a 生物学の male who is '肉体的に 損なわれていない' ― that is, who 所有するs a penis ― has the 権利 to choose to be 融通するd on a 女性(の) 区 and to use women's lavatories and 施設s.

Many biologically 女性(の) 患者s have understandably been left distraught, 軍隊d to 株 some of their most intimate and 攻撃を受けやすい moments と一緒に a member of the opposite sex.

Others, like those in the 区 乱すd by their presence, have been left uncomfortable to a degree.?

Still others, as my 特派員s from across the NHS have said, are 申し立てられた/疑わしい to have seen or experienced far worse.

Yet, often, they 反対する at their 危険,危なくする. Many of those who have 表明するd 不快 at this turn of events ― be they 患者s or nursing staff ― have been (刑事)被告 of transphobia and hate 罪,犯罪. Some nurses have lost their 職業s.

Hard to believe, isn't it?

Hospitals are 免除された from the Equalities 行為/法令/行動する of 2010, which 無法者d 差別 or 不公平な 治療 on the basis of 確かな personal 特徴, の中で them age, 宗教 or 性の orientation.?

It means they were one of the few places where you can ― or could ― 主張する on the privacy of a 選び出す/独身-sex space.

Moreover, that 権利 had been hard-won in only 最近の history. While 選び出す/独身-sex 区s were 基準 practice for 10年間s, in the late-1970s and 早期に-1980s the NHS started to move に向かって mixed-sex 区s to 削減(する) nursing costs and make the best use of 減らすing numbers of staff.

It led to 普及した (民事の)告訴s, 特に from 女性(の) 患者s worried about 存在 in beds と一緒に male 患者s, and 株ing washing 施設s with them.?

It took years of ロビーing from health professionals and organisations ― の中で them the Mail ― for the 法律 to change.

That happened in 2011, when a redrafted 見解/翻訳/版 of the 患者's 借り切る/憲章 発表するd mixed-sex hospital 区s were to be 段階d out, with 患者s given the 権利 to request a bed on a 選び出す/独身-sex 区.

Separate lavatorie s also had to be 供給するd on 存在するing mixed-sex 区s. Since April that year, 信用s have been 罰金d £250 when a 患者 is placed on a mixed-sex 区.

Of course, there are exceptions. There are 臨床の circumstances where mixed-sex accommodation can be 正当化するd, for example, 患者s who need specialised care, such as in 批判的な care 部隊s.

And, let me be (疑いを)晴らす, no one would want to 否定する the 権利s of a 攻撃を受けやすい trans person to be (許可,名誉などを)与えるd the 尊敬(する)・点 of hospital accommodation that best caters to their needs, both emotional and physical.

I 高く評価する/(相場などが)上がる there are no 平易な answers, as there rarely are when it comes to overlapping 権利s. But it must be discussed 率直に, not in secret.

Sadly, what is happening in 区s up and 負かす/撃墜する the count ry is that that very basic 尊敬(する)・点 for a 患者's 権利s is 存在 overturned.

In September 2019, NHS England and NHS 改良 published a 改訂するd 見解/翻訳/版 of their 指導/手引.?

They advised 患者s should be 融通するd によれば their 贈呈: the way they dress, and the 指名する and pronouns they use.?

This has formed the basis of a change of 政策 in a number of NHS 信用s, some of whom 結論するd this 権利 should be 延長するd to male-born sex 違反者/犯罪者s, telling staff that while a 犯罪の history should be part of a '危険 査定/評価' it is not a 妨げる/法廷,弁護士業 to admission.

Leaving aside the momentousness of that 声明, the 根底となる point is that this has been done without discussion.?

In their haste to 主張する the primacy of 'Self-身元確認,身分証明' ― in which a person can 合法的に 宣言する their own gender 関わりなく their biology ― NHS 長,指導者s have knowingly distorted the equality 法律s that 議会 has passed and the Queen herself has 調印するd.

And it is women who are 支払う/賃金ing the price. As a woman who has spent a 広大な/多数の/重要な 取引,協定 of her adult career (選挙などの)運動をするing for the 権利s of women and children, I approached 同僚s to form an all-party (選挙などの)運動をする group to collect 証拠 from 患者s and medics on the 衝撃 of the deviation from 選び出す/独身-sex spaces.

The examples we have received are legion.?

In hundreds of emails and hours of personal 証言, we have heard 事例/患者s 範囲ing from dementia 患者s 苦しめるd at waking up next to someone who, in their mind, looks like a man, to 報告(する)/憶測s of a 強姦 on a psychiatric 部隊 undertaken by a 生物学の male who identified as a woman.?

And last night, Health 長官 Sajid Javid tweeted: 'It's not wrong to look at whether 指導/手引 is 権利, or how it's 存在 適用するd, to 安心させる everyone... I've asked [the Department] for advice.'

It is time he did so, whatever the 熱狂的興奮状態 it may 刺激する.

I am in no 疑問 my forays into the whirlpool of transgender 問題/発行するs leave me open to 乱用. I 辞退する to be cowed by it: it hasn't worried me in the past, just as sticking my 長,率いる above the parapet now doesn't worry me.

When you speak up for what is 権利 there will always be those who 耐える 取り消しs from much-loved 会・原則s; it doesn't 事柄.

What does 事柄 is that we find a way of 保護するing the 攻撃を受けやすい.

In my work around the globe, I have always 特記する/引用するd the country of my birth as a 向こうずねing example of a nation which 支持するs the 権利s of women, and our NHS as a beacon of health care 準備/条項.

However, the スキャンダル that is 広げるing in our 選び出す/独身-sex 区s has led me to 結論する that neither of these 布告/宣言s remains true.
