California will try to enshrine 権利 to same-sex marriage

SACRAMENTO, Calif. (AP) - California, a U.S. trendsetter for 進歩／革新的な 政策s and a 明言する／公表する where the 現在の 知事 once made news 問題／発行するing marriage licenses to same-sex couples in San Francisco before it was 合法的な, will 試みる／企てる to enshrine marriage equality in the 明言する／公表する 憲法.

The 成果／努力 comes 15 years after a 投票者-認可するd 率先, Proposition 8, banned the 明言する／公表する from 認めるing same-sex marriages. In 2013, the U.S. 最高裁判所 （疑いを）晴らすd the way for same-sex marriage in California. The 憲法の 改正 is still on the 調書をとる／予約するs, however, and that worries 支持するs who think the high 法廷，裁判所 may revisit the 2015 事例／患者 that 合法化するd gay marriage 全国的な.

"It´s 絶対の 毒（薬）, it is so destructive and it´s humiliating that this is in our 憲法," said Scott Wiener, a 明言する／公表する 上院議員 who 代表するs San Francisco.

Wiener and 議会 Member Evan Low of Silicon Valley, both 民主党員s and members of the California 法律を制定する LGBTQ （政党の）幹部会，党集会, introduced 法律制定 Tuesday to 無効にする Proposition 8. The 手段 would need to be 認可するd in the 立法機関 by a two-thirds 投票（する）, and then it will 最終的に 落ちる to 投票者s to decide 経由で a 国民投票.

Gov. Gavin Newsom 発表するd his support for the 廃止する.

"It´s time that our 法律s 断言する marriage equality 関わりなく who you are or who you love," the 民主党員 said. "California stands with the LGBTQ+ community and their 権利 to live 自由に."

In the days 主要な up to Proposition 8´s 是認, Low joined 対抗者s of the 手段 outside his 母校 De Anza College in Cupertino, California, to call on 投票者s to 拒絶する the 率先. When it passed, it felt personal to Low, who is gay.

"Why do fellow Californians hate me?" he said. "Why do they feel that my 権利s should be 除去するd?"

California could follow in the footsteps of Nevada, which in 2020 became the first 明言する／公表する to 修正する its 憲法 to 確実にする the 権利 to same-sex marriage. The 事柄 took on fresh 緊急 last year when the U.S. 最高裁判所 overturned the 権利 to an abortion 設立するd by 魚の卵 v. Wade. At the time, 最高裁判所 司法（官） Clarence Thomas called into question other 目だつ 事例／患者s and 勧めるd the 法廷，裁判所 to 再考する them. His 名簿（に載せる）／表（にあげる） 含むd Obergefell v. Hodges, which 軍隊d 明言する／公表するs to 問題／発行する and 認める same-sex marriages.

"In 未来 事例／患者s, we should 再考する all of this 法廷，裁判所´s 事実 予定 過程 precedents, 含むing Griswold, Lawrence, and Obergefell," Thomas wrote, 言及／関連ing two other 目印 事例／患者s 伴う／関わるing 接近 to birth 支配（する）／統制する and a 決定／判定勝ち（する） striking 負かす／撃墜する 法律s against same-sex 性の activity.

In December, 大統領 Joe Biden 調印するd into 法律 the 尊敬（する）・点 for Marriage 行為／法令／行動する, wh ich 要求するs 明言する／公表するs to 認める same-sex marriages, but the 法律制定 doesn´t 軍隊 明言する／公表するs to 許す them if Obergefell is overturned.

Wiener and Low, the two California 国会議員s, hope to replicate the 過程 under which 明言する／公表する 投票者s in November 認可するd a 憲法の change 保証（人）ing the 権利 to abortion.

Jeremy Yancey and Fabio de Andrade, who got married Tuesday at a Valentine's Day 祝賀 at San Francisco City Hall, said Proposition 8's 廃止する is 延滞の.

"It's about time. 保護するing our 権利s as human 存在s is very 決定的な," Yancey said. "It should've happened many years ago."

議会 Member Greg Wallis, a 共和国の／共和党の 代表するing part of San Bernadino 郡, said in a 声明 that he was proud to co-author the 法律制定.

"The reality is that marriage is a 契約 and かかわり合い between any two people in love, and it's high time we make that （疑いを）晴らす," Wallis said.

The path to marriage equality in the Golden 明言する／公表する was uneven. In 2000, 投票者s 認可するd a 法令 that banned the 承認 of same-sex marriages, a 手段 that was overturned by the 法廷，裁判所s. Newsom, who became San Francisco's 市長 in 2004, 問題／発行するd marriage licenses to same-sex couples in the city in a move that 反抗するd the 法律 and ran 反対する to 見解（をとる）s then held by many in his party. In 2005, the California 立法機関 was ahead of all other 明言する／公表するs when it passed a 法案 to 合法化する same-sex marriage. But then-Gov. A rnold Schwarzenegger, a 共和国の／共和党の, 拒否権d it.

Support for marriage equality has 速く 拡大するd since the Obergefell 判決，裁定. While Mormon groups helped 基金 the Proposition 8 （選挙などの）運動をする in California, The Church of Jesus Christ of Latter-day Saints （機の）カム out in support of the 尊敬（する）・点 for Marriage 行為／法令／行動する.

Tony Hoang, (n)役員／(a)執行力のある director of Equality California, is 楽観的な the group can help build a large supportive 連合 for the 提案するd 改正.

"I know this will be a bipartisan （選挙などの）運動をする," he said.
