Virginians 直面する テロ行為 告発(する),告訴(する)/料金s years after Pakistan 裁判,公判

ALEXANDRIA, Va. (AP) - It was almost 15 years ago when five young men from northern Virginia left the U.S. to 追求する dreams of jihad in Afghanistan, only to find themselves under 逮捕(する) in Pakistan when their 別れの(言葉,会) ビデオ 誘発するd family members to 接触する the 連邦検察局.

Now, after the five served a 10年間 in a Pakistani 刑務所,拘置所, U.S. 検察官,検事s are moving 今後 with 計画(する)s to put them on 裁判,公判 again for テロ行為 告発(する),告訴(する)/料金s.

At a status 審理,公聴会 Tuesday in U.S. 地区 法廷,裁判所 in Alexandria, however, a 裁判官 gave strong 指示,表示する物s that she 計画(する)s to 投げ上げる/ボディチェックする out 告発(する),告訴(する)/料金s against one of the men on grounds that 拷問 and 独房監禁 confinement he 恐らく 耐えるd in Pakistan have (判決などを)下すd him mentally incompetent.

In fact, U.S. 地区 裁判官 Leonie Brinkema has questioned the 公共事業(料金)/有用性 of bringing 告発(する),告訴(する)/料金s against any of the five, given the fact that they were 罪人/有罪を宣告するd and punished already in Pakistan.

"If these men have been 起訴するd in Pakistan and served 重要な periods of incarceration in a Pakistani 刑務所,拘置所, and now the 部隊d 明言する/公表するs 政府 is trying to 告発(する),告訴(する)/料金 them for essentially the same 行為/行う in this country, you´ve got to think about whether that makes sense," Brinkema said during a December status 審理,公聴会 on the 事例/患者.

In late 2009, the five left the U.S. for Pakistan, leaving behind an 11-minute ビデオ espousing the need to engage in 宗教上の war to defend イスラム教徒 lands under attack. Family members sought to stop them from making the trip once they learned of the 計画(する)s, reaching out to a イスラム教徒 civil 権利s group, the 会議 on American-Islamic Relations, and 結局 to lawyer Nina Ginsberg and the 連邦検察局.

But the five had already made it to Pakistan and began looking for people who could help them get to Afghanistan. They were frequently turned away by those they sought out, によれば a recently unsealed 連邦検察局 a ffidavit, although one man 示唆するd he could help if one of the five's 延長するd family in Pakistan could vouch for them.

They were 逮捕(する)d in Sargodha, a city in the eastern 州 of Punjab, on Dec. 9, 2009, about nine days after the 連邦検察局 learned they left the U.S., によれば the affidavit.

Several members of the group 認める to 連邦検察局 スパイ/執行官s that their goal was to fight against American 軍隊/機動隊s if they got to Afghanistan.

The five were 告発(する),告訴(する)/料金d in Pakistan, where they say they were 拷問d during their 拘留,拘置 - 主張s 否定するd by Pakistani 当局. All five were 罪人/有罪を宣告するd and received 10-year 条件.

After serving their 宣告,判決s, the U.S. 政府 has sought to bring them to the U.S. to 直面する 告発(する),告訴(する)/料金s here. So far, though, only three of the 被告s - Zamzam, Yemer and Minni - have been 国外追放するd 支援する to the U.S. A fourth remains in Pakistani 保護/拘留, and a fifth is 捕まらないで there.

Yemer, who was just 18 when he was 逮捕(する)d and is the youngest of the five, 直面するs serious mental health problems. Ginsberg, his lawyer, said in 法廷,裁判所 that Yemer's faculties eroded after 虐待 and 独房監禁 confinement in Pakistan. As she 述べるd it, Yemer sits in a 議長,司会を務める all day, nonresponsive. He only eats if he is fed, and he only goes to the bathroom if someone takes him to a 洗面所.

Months in a hospital, 含むing electroshock 治療, were 大部分は 不成功の, she said.

"They just 全く incapacitated him," Ginsberg said after Tuesday's 審理,公聴会, in which her (弁護士の)依頼人 appeared dressed in a gray tracksuit, his 直面する blank.

Ginsberg said during the 審理,公聴会 that she was 希望に満ちた the U.S. would 減少(する) the 告発(する),告訴(する)/料金s against her (弁護士の)依頼人. Brinkema gave (疑いを)晴らす 指示,表示する物 she will 解任する the 告発(する),告訴(する)/料金s against Yemer as soon as Ginsberg とじ込み/提出するs a 動議 捜し出す ing 解雇/(訴訟の)却下 関わりなく whether the 司法(官) Department agrees.

As for the other 被告s, 検察官,検事 John Gibbs 表明するd 楽観主義 that a 嘆願 取引,協定 will be reached and 回避する the need for a 裁判,公判. Lawyers for Zamzam and Minni have said that if a 取引,協定 can't be reached, they 計画(する) to 捜し出す 解雇/(訴訟の)却下 on grounds that their (弁護士の)依頼人s were 否定するd the 権利 to a 迅速な 裁判,公判, の中で other 可能性のある 問題/発行するs.

At a 審理,公聴会 in December, Brinkema raised the question of whether a U.S. 裁判,公判 would 量 to 二塁打 jeopardy, although it was not すぐに (疑いを)晴らす whether the 裁判,公判 in Pakistan would 許す the 被告s to (人命などを)奪う,主張する 二塁打 jeopardy 保護 in the U.S.

Ginsberg, for her part, said she doesn't believe the men deserve any その上の incarceration in the U.S.

"Ten years in a Pakistani 刑務所,拘置所 is like 30 years in the U.S.," she said. "They've had enough."
