He spoke no English, had no lawyer. An Afghan man's 事例/患者 申し込む/申し出s a glimpse into US 移民/移住 法廷,裁判所

The Afghan man speaks only Farsi, but he wasn't worried about 代表するing himself in U.S. 移民/移住 法廷,裁判所. He believed the 詳細(に述べる)s of his 亡命 (人命などを)奪う,主張する spoke for themselves.

Mohammad was a university professor, teaching human 権利s courses in Afghanistan before he fled for the 部隊d 明言する/公表するs. Mohammad is also Hazara, an 民族の 少数,小数派 long 迫害するd in his country, and he said he was receiving death 脅しs under the Taliban, who reimposed their 厳しい 解釈/通訳 of Sunni Islam after taking 力/強力にする in 2021.

He crossed the Texas 国境 in April 2022, 降伏するd to 国境 Patrol スパイ/執行官s and was 拘留するd. A year later, a 審理,公聴会 was held 経由で ビデオ 会議/協議会. His words were translated by a 法廷,裁判所 interpreter in another 場所, and he said he struggled to 表明する himself - 含むing 恐れる for his life since he was 負傷させるd in a 2016 自殺 爆破.

At the 結論 of the nearly three-hour 審理,公聴会, the 裁判官 否定するd him 亡命. Mohammad said he was later shocked to learn that he had waived his 権利 to a ppeal the 決定/判定勝ち(する).

"I feel alone and that the 法律 wasn´t 適用するd," said Mohammad, who spoke to The Associated 圧力(をかける) on 条件 that only his first 指名する be used, over 恐れるs for the safety of his wife and children, who are still in Afghanistan.

AP reviewed a 審理,公聴会 transcript 供給するd by Mona Iman, an 弁護士/代理人/検事 with Human 権利s First now 代表するing Mohammad. Iman also translated Mohammad's comments to AP in a phone interview from Prairieland 拘留,拘置 中心 in Alvarado, Texas.

The 事例/患者 反映するs an 亡命 探検者 who was ill-equipped to 代表する himself and 明確に didn´t understand what was happening, によれば 専門家s who reviewed the transcript. But at least one former 裁判官 同意しないd and said the 判決,裁定 was fair.

Now Mohammad's 弁護士/代理人/検事 has won him a new 審理,公聴会, before a different 裁判官 - a rar e second chance for 亡命 事例/患者s. Also giving Iman hope is a 決定/判定勝ち(する) this week by the Biden 行政 to give 一時的な 合法的な status to Afghan migrants living in the country for more than a year. Iman believes he qualifies and said he will 適用する.

But Mohammed has been in 拘留,拘置 for about 18 months, and he 恐れるs he could remain in 保護/拘留 and still be considered for 国外追放.

AP sought 詳細(に述べる)s and comment from U.S. 移民/移住 and Customs 施行. The 機関 didn´t 演説(する)/住所 questions on Mohammad´s 事例/患者 but said noncitizens can 追求する all 予定 過程 and 控訴,上告s and, once that´s exhausted, 裁判官s´ orders must be carried out.

For his April 27 審理,公聴会, Mohammad submitted photos of his 傷害s from the 2016 自殺 爆破 that killed hundreds at a 平和的な demonstration of mostly Hazaras. He also gave the 法廷,裁判所 脅すing letters from the Taliban and 医療の 文書s from 治療 for 長,率いる 負傷させるs in 2021. He said 交戦的なs (警官の)巡回区域,受持ち区域 him with sticks as he left the university and 発射 at him but 行方不明になるd.

In 法廷,裁判所, the 政府 argued that Mohammad encouraged 移住 to the U.S. on social マスコミ, changed dates and 詳細(に述べる)s 関係のある to his history, and had 親族s in Europe, South America and other places where he could have settled.

In 判決,裁定, 裁判官 Allan John-Baptiste said the 脅しs didn't 示す Mohammad would still be at 危険, and that his wife and children hadn't been 害(を与える)d since he left.

Mohammad tried to keep arguing his 事例/患者, but the 裁判官 told him the evidentiary period was の近くにd. He asked Mohammad whether he planned to 控訴,上告 or would waive his 権利 to do so.

Mohammad kept 述べるing his (人命などを)奪う,主張する, but John-Baptiste reminded him he'd already 支配するd. Mohammad said if the 裁判官 was going to ignore the 人道的な 状況/情勢 in Afghanistan, he wouldn't ask for an 控訴,上告. John-Baptiste 示すd he had considered it.

"You were not 攻撃する,衝突する by the 射撃 or the 自殺 爆撃機," John-Baptiste said. "The 害(を与える) that you received does not rise to the level of 迫害."

Mohammad continued, explaining how his family lives in hiding, his wife 隠すing her 身元 with a burqa.

"承認する, are you going to 控訴,上告 my 決定/判定勝ち(する) or not?" John-Baptiste 最終的に asked.

"No, I don't," Mohammad said.

"And we don´t want you to make the 決定/判定勝ち(する) now that you can´t come 支援する later and say you want to 控訴,上告. This is final, 承認する, sir?" John-Baptiste said.

"Yes. 承認する, I 受託する that," Mohammad said.

He later asked whether he could try to come 支援する 合法的に. The 裁判官 started to explain voluntary 出発, which would 許す him to return in いっそう少なく than a 10年間, but 訂正するd himself and said Mohammad didn't qualify.

"I´m sorry about that, but, you know, I´m just going to have to order you 除去するd," John-Baptiste said. "I wish you the best of luck."

Mohammad later told AP he couldn't comprehend what was happening in 法廷,裁判所. He'd heard from others in 拘留,拘置 that he had a month to 控訴,上告.

"I didn´t understand in that moment that the 権利 would be taken from me if I said no," he said.

Former 移民/移住 j udge Jeffrey Chase, who reviewed the transcript, said he was surprised John-Baptiste waived Mohammad´s 権利 to 控訴,上告 and that the Board of 移民/移住 控訴,上告s upheld that 決定/判定勝ち(する). 事例/患者 法律 supports 認めるing 保護 for people who belong to a group long 迫害するd in their 母国s even if an individual cannot 証明する 明確な/細部 脅しs, said Chase, an 助言者 to the 控訴,上告s board.

But Andrew Arthur, another former 移民/移住 裁判官, said John-Baptiste 支配するd 適切に.

"The 回答者/被告 knew what he was とじ込み/提出するing, understood all of the questions that were asked of him at the 審理,公聴会, understood the 決定/判定勝ち(する), and 自由に waived his 権利 to 控訴,上告," Arthur, a fellow at the 中心 for 移民/移住 熟考する/考慮するs, which 支持するs for 移民/移住 制限s, said 経由で email.

Before Mohammad decided to 逃げる, his wife 適用するd for a special 移民,移住(する) ビザ, which 認めるs 永久の residency to Afghans who worked for the U.S. 政府 or 軍の, along with their families.

But that and other 合法的な pathways can take years. While they waited, Mohammad said, the Taliban (機の)カム looking for him but instead 拘留するd and (警官の)巡回区域,受持ち区域 his 甥. Mohammad 述べるd making the 破滅的な 決定/判定勝ち(する) to leave his family, who had no パスポートs.

He 選ぶd for a 背信の 大勝する through 多重の countries to cross the U.S.-Mexico 国境, which has seen the number of Afghans jump from 300 to 5,000 in a year.

Mohammad said he crossed into Pakistan, flew to Brazil and 長,率いるd north. He slept on buses and trekked through パナマ's 悪名高い Darien Gap ジャングル, where he said he saw 団体/死体s of migrants who didn't make it.

Mohammad planned to live with a niece in North Carolina. Now he 恐れるs if he's sent home and his wife gets her ビザ, they'll be separated again.

国外追放s to Afghanistan are 極端に rare, with a handful each year.

弁護士/代理人/検事 Iman said they're 感謝する Mohammad's 事例/患者 has been 再開するd, with a 審理,公聴会 scheduled for Oct. 4. She is fighting for his 即座の 解放(する).

"I have no 疑問 that his 事例/患者 would have turned out 異なって had he been 代表するd," Iman said. "This is 正確に/まさに the type of 攻撃を受けやすい individual that the U.S. 政府 has 約束d, has committed to 保護する, since it withdrew from the country."
