FAA, developers 衝突/不一致 over tall buildings

WASHINGTON (AP) ― The 政府 wants to 劇的な 減ずる the allowable 高さ of 潜在的に thousands of buildings 近づく airports around the country ― a 提案 that is 製図/抽選 解雇する/砲火/射撃 from real 広い地所 developers, 地元の 公式の/役人s and members of 議会 who say it will 傷つける 所有物/資産/財産 values.

The 連邦の 航空 行政 提案, supported by airports and 航空機によるs, is driven by encroaching 開発 that 限界s 安全な flight paths for 計画(する)s that might lose 力/強力にする in an engine during 離陸/出発. 計画(する)s can 飛行機で行く with only one engine, but they have いっそう少なく 力/強力にする to climb quickly over 障害s.

地元の 商売/仕事 leaders, who see airports as a means to attract 開発, say they 恐れる office towers and condominium コンビナート/複合体s will have to be put on 持つ/拘留する until developers and zoning boards can 人物/姿/数字 out what the 機関's 提案 means for their communities. In Tempe, Arizona, for example, 地元の 議会 of 商業 大統領 Mary Ann Miller said she 恐れるs almost any new building in the city's downtown would 直面する new 制限s because the community is 位置を示すd 近づく the 辛勝する/優位 of 不死鳥/絶品 Sky Harbor's 滑走路s.

"Coming out of a very long 後退,不況, we hate the idea of stopping some growth," she said.

In Florida, the Miami City (売買)手数料,委託(する)/委員会/権限 passed a 決意/決議 two weeks ago that said the 提案 "may be detrimental to the 全体にわたる growth and 経済的な 繁栄" of the city's downtown and 勧めるd the FAA to 行為/行う a 熟考する/考慮する of its 可能性のある 経済的な 衝撃 before moving 今後.

航空機によるs have to 計画(する) for the 可能性 that a 計画(する) could lose the use of an engine during 離陸/出発 even though that doesn't happen very often. As more buildings, cellphone towers, 勝利,勝つd turbines and other tall structures go up 近づく airports, there are より小数の 安全な flight paths 利用できる. 現在の 規則s 効果的に 限界 building 高さs based on the 量 of 通関手続き/一掃 needed by 計画(する)s with two operating engines.

航空機によるs already must いつかs 削減(する) 負かす/撃墜する on the number of 乗客s and the 量 of 貨物 carried by 計画(する)s taking off from airports in Burbank and San Jose in California, and in Honolulu, Los Angeles, Miami, 不死鳥/絶品, and 近づく Washington, D.C., の中で others, so they will be light enough to (疑いを)晴らす obstructions if only one engine is 利用できる, said Chris Oswald, 副/悪徳行為 大統領,/社長 of the Airports 会議 International-North America.

The problem is 悪化させるd in hot 天候 when 空気/公表する is いっそう少なく dense and 計画(する)s 要求する more 力/強力にする during 離陸/出発. Bigger 計画(する)s that carry lots of 乗客s and 貨物 on lucrative international flights are 特に 影響する/感情d.

Airports worry that the problem could cost 航空機によるs enough money that they'll find some 大勝するs 無益な and 除去する service, Oswald said.

The FAA's 提案 would change the way the 機関 査定する/(税金などを)課すs 提案s to build new structures or 修正する 存在するing structures 近づく 388 airports to take into account the hazard that would be created to one-engine 離陸/出発s. For example, under the 提案 未来 buildings 建設するd 10,000 feet from the end of a 滑走路 and within a 指定するd flight path would have a 最大限 allowable 高さ of 160 feet instead of the 現在の 限界 of 250 feet, によれば an 分析 by the Weitzman Group, a New York real 広い地所 協議するing 会社/堅い. As the distance from an airport 増加するs, the allowable building 高さ 増加するs 同様に. The 提案 could 影響する/感情 buildings as far as 10 miles from an airport.

計画(する)s taking off usually follow one of about a half-dozen possible flight paths. To 限界 the number of buildings and other structures 影響する/感情d by the 提案, the FAA is recommending airports and 地元の zoning boards work together to select a 選び出す/独身 flight path for each 滑走路 that 計画(する)s can use in the event that an engine やめるs, said John Speckin, the FAA 副 地域の 行政官/管理者 in 告発(する),告訴(する)/料金 of the 提案. The new 高さ 限界s would only 適用する to structures in that p ath, he said.

"We're trying to create a balance of the 航空 needs and the 開発 needs in the 地元の community," he said in an online 要点説明 Wednesday.

But even with that 制限, thousands of 存在するing and planned structures would be 影響する/感情d, said Peter Bazeli, who wrote the Weitzman 分析. 存在するing buildings along the path would not have to be altered, but a 所有物/資産/財産 owner who 手配中の,お尋ね者 to 増加する the 高さ of a building or 取って代わる it with a taller building might be out of luck.

"Just one flight path could cover hundreds and hundreds of acres in 密集して developed areas," Bazeli said. "You are going to be bumping up against some very 価値のある 所有物/資産/財産 権利s."

The FAA doesn't have the 当局 to tell owners how high a building can be. But 所有物/資産/財産 owners 近づく airports are supposed to 適用する to the FAA before construction for a 決意 on whether a 提案するd building or 革新 現在のs a hazard to 航海. 築くing a building that the FAA says is a hazard is akin to building in a flood plain ― 保険 率s go up, mortgages are harder to get and 所有物/資産/財産 values 減少(する). 地元の zoning 法律s often don't 許す construction of buildings 決定するd to be an 航空 hazard.

The FAA's 提案 has created "a real 広い地所 and developer firestorm," said Ken Quinn, a former FAA 長,指導者 counsel who is 代表するing several developers. "A 選び出す/独身 building can be 価値(がある) $100 million and more. If you are talking about lopping off whole 床に打ち倒すs, you can 廃虚 the 経済的な proposition and you can destroy the viability of the building, so you are talking about easily a $1 billion in 経済的な 衝撃."

Cellphone tower owners and 操作者s are also 関心d.

"A change in the 最大限 allowable 高さ of in frastructure surrounding airports ... could degrade wireless service ニュース報道 and capacity," PCIA, a 貿易(する) 協会 for the wireless 産業, said Wednesday in a letter to House Transportation and 組織/基盤/下部構造 委員会 members.

The real 広い地所 and wireless 産業s want the FAA 提案 to be put through a formal rulemaking 過程, which can take years to 完全にする. When an 機関 提案するs a new 支配する, it also has to show that the 利益s outweigh the cost to society. That makes it easier for 産業s to challenge the 支配する. FAA 公式の/役人s have chosen instead to 扱う/治療する the 提案 as a 政策 change, 除去するing the need to 会合,会う rulemaking 必要物/必要条件s.

A 法案 recently introduced by Democratic Rep. Jim Moran, whose Northern Virginia 地区 含むs 密集して 居住させるd areas around Reagan 国家の Airport 近づく downtown Washington, would 要求する the FAA to 行為/行う a formal rulemaking. In a letter earlier this year to Transportation 長官 Anthony Foxx, Moran and three other 国会議員s 表明するd 関心 that the 提案 would have a "detrimental 影響 on the 開発 and marketability of airports 同様に as 妨げる 職業 創造 and 縮む the 税金 base of 地元の 政府s."
