議会 takes another 割れ目 at war 記念の cross
WASHINGTON (AP) ― Could one of the nation's longest-running church-明言する／公表する 衝突s be 近づくing a 結論?
As part of a 法案 setting 弁護 政策, 議会 would 権限を与える the 弁護 長官 to 移転 a scenic 小包 of 連邦の land in the La Jolla section of San Diego, to a 私的な group. The 小包 含む／封じ込めるs a 記念の to the nation's 退役軍人s and a 43-foot-high cross that 連邦の 法廷，裁判所s have 決定するd is an 憲法違反の 成果／努力 by the 政府 to 是認する a 宗教.
Tens of thousands of people visit 開始する Soledad ever year to take in a 見解（をとる） that 含むs the 太平洋の Ocean to the west, downtown San Diego to the south and the Laguna Mountains to the east. On the same 丘の頂上 sits the 開始する Soledad 退役軍人s 記念の. The 記念の's most 支配的な feature is a white cross that has been the 焦点（を合わせる） of seemingly unending litigation.

Last year, a 連邦の 裁判官 ordered the 連邦の 政府 and 弁護 長官 Chuck Hagel to 除去する the cross. It was the 裁判官's 返答 to a 判決，裁定 two years earlier from the 9th U.S. 回路・連盟 法廷，裁判所 of 控訴，上告s.
"There is no 記念の on public land in which the cross 持つ／拘留するs such a pivotal and 課すing stature, dwarfing by every 手段 the 世俗的な plaques and other symbols 祝う／追悼するing 退役軍人s," 裁判官 M. Margaret McKeown wrote in the 控訴裁判所's 決定／判定勝ち（する）.
議会 is entering the fray ― again. This time, it's through a 法案 the House passed Thursday and the 上院 is 推定する／予想するd to 認可する next week.
The 手段 calls for the land 含む／封じ込めるing the 記念の to be transferred to the 開始する Soledad 記念の 協会 Inc., a group that has been 持続するing the 施設 through 会員の地位 料金s, 寄付s and placement of some 3,600 plaques 栄誉（を受ける）ing individual 退役軍人s. People, 一般に families of the 退役軍人, 支払う／賃金 a 料金 範囲ing from $950 to $1,800 to have a plaque 任命する／導入するd.
The 連邦の 政府 has owned the land since 2006, when 共和国の／共和党の Rep. Duncan Hunter authored 法律制定 transferring 所有権 from the city of San Diego. At the time, the city 直面するd 罰金s of $5,000 each day if it did not 除去する the cross.
Now, Rep. Duncan Hunter Jr. is spearheading congressional 成果／努力s to keep the 記念の and its cross through another land 移転. Hunter に例えるd the cross on 開始する Soledad to the crosses and 星／主役にするs of David that appear on the markers and gravestones at Arlington 共同墓地.
"Each headstone is a minimemorial to the men and women who died and served," Hunter said. "It's the same thing. Ours is just a whole lot bigger."
Hunter's 準備／条項 規定するs that the 弁護 長官 伝える the 記念の to the 地元の 協会 after 協定 is reached on price. The 協会 and any その後の owner would be 要求するd to 持続する the structure as a 退役軍人s 記念の in perpetuity.

Then again, after more than a ４半期/4分の1 century of litigation, no one familiar with the 合法的な 論争 will be surprised if this 最新の 成果／努力 落ちるs short.
A 類似の church-明言する／公表する 衝突 in California's Mojave 砂漠 was 解決するd two years ago when, as a part of a 法廷，裁判所 解決／入植地, a 連邦の 裁判官 permitted the 国家の Park Service to turn over an acre of land to a pair of 退役軍人s groups in 交流 for five acres of 所有物／資産／財産 どこかよそで in the 砂漠.
Before the 連邦の 政府 acquired the 記念の and its cross, the city of San Diego had tried to sell i t to the 開始する Soledad 記念の 協会 on two occasions. Neither 試みる／企てる passed 召集（する） in the 法廷，裁判所s.
James McElroy, a 地元の 弁護士／代理人／検事, said he can't say yet whether 議会's 最新の 成果／努力 will 満足させる （弁護士の）依頼人 Steve Trunk, an atheist and Vietnam 退役軍人 who is 告訴するing the 連邦の 政府. The ユダヤ人の War 退役軍人s of the 部隊d 明言する／公表するs of America Inc. have joined Trunk in the 控訴.

McElroy said he also has questions about whether the 記念の 協会 will 支払う／賃金 a fair price for the 所有物／資産／財産 and whether it has the 権利 to take the cross 負かす／撃墜する.
