Trump victory could imperil 魚の卵 v. Wade abortion 判決,裁定

NEW YORK (AP) ― 魚の卵 v. Wade, the 1973 最高裁判所 決定/判定勝ち(する) 合法化するing abortion 全国的な, could be in jeopardy under Donald Trump's 大統領/総裁などの地位. If a reconfigured high 法廷,裁判所 did overturn it, the likely 結果 would be a patchwork 地図/計画する: some 明言する/公表するs 保護するing abortion 接近, others 制定するing 堅い 禁止(する)s, and many struggling over what new 限界s they might 課す.

Trump, who will have at least one 最高裁判所 vacancy to fill, has 誓約(する)d to 任命する "プロの/賛成の-life" 司法(官)s who 潜在的に would be open to 弱めるing or 逆転するing 魚の卵. With one seat 空いている, the high 法廷,裁判所 now has a 5-3 大多数 supporting abortion 権利s, and thus one of those five would need to vacate his or her seat to give the 法廷,裁判所 an anti-abortion 大多数.

Trump broached that 可能性 in an interview 空気/公表するd Sunday night on CBS' "60 Minutes," 示唆するing that a 逆転 of 魚の卵 would return the 事柄 to the 明言する/公表するs, leaving it up to their 立法機関s to decide the 未来 of abortion 接近.

Asked about the 見込み that some women would 直面する abortion 禁止(する)s in their 明言する/公表するs, Trump replied, "井戸/弁護士席, they'll perhaps have to go, they'll have to go to another 明言する/公表する."

支持者s of abortion 権利s concurred with that 分析.

"If 魚の卵 were overturned, we would likely return to a patchwork quilt of 法律s, which would 軍隊 women の上に the road even more than at 現在の," said Dr. David Grimes, a North Carolina obstetrician-gynecologist.

Grimes was alluding to the fact that many 明言する/公表するs under 共和国の/共和党の 支配(する)/統制する already have 軍隊d 終結 of some abortion clinics, 直面するing some women with the need for long-distance travel ーするために 得る an abortion. While 豊富な women might be able to afford such travel, it can be an insurmountable 重荷(を負わせる) for some low-income women.

"Is that the world we want, where wom en's ability to get the care she needs depends on her ability to go to another 明言する/公表する?" asked Jennifer Dalven, director of the American Civil Liberties Union's Reproductive Freedom 事業/計画(する).

Anti-abortion leader Clark Forsythe, 事実上の/代理 大統領,/社長 and 上級の counsel for Americans 部隊d For Life, 予報するd that the 明言する/公表するs would break into three basic 部類s if 魚の卵 were overturned: Perhaps a dozen 明言する/公表するs would continue to make abortion 広範囲にわたって accessible, another dozen or so would 禁止(する) 事実上 all abortions unless the mother's life were at 火刑/賭ける, and 概略で two-dozen more 明言する/公表するs would thrash out their 返答 with 審議 の中で the public and in the 立法機関s. Forsythe 示唆するd that some of those 明言する/公表するs might 許す abortions in the first trimester of pregnancy, while 制限するing or banning later abortions.

の中で the 明言する/公表するs likely to 持続する 十分な 接近 to abortion are those on the 太平洋の Coast and in the Northeast. South-central and southeastern 明言する/公表するs would be の中で those likely to 課す 禁止(する)s, 潜在的に leaving women in a 抱擁する, contiguous chunk of the 部隊d 明言する/公表するs with no nearby 接近 to abortion providers.

"For many women, it's not possible to 横断する across 多重の 明言する/公表する lines," said Nancy Northup, 大統領,/社長 of the 中心 for Reproductive 権利s. "This could have 悲劇の consequences."

She said one consequence might be an 増加する in the number of women 捜し出すing to self-induce an abortion.

Florida, compared to other Southern 明言する/公表するs, has a large number of abortion clinics ― more than 70, によれば the most 最近の count by the Guttmacher 学校/設ける, a 研究 group which supports abortion 権利s.

Laura Goodhue, (n)役員/(a)執行力のある director of the Florida 同盟 of Planned Parenthood (v)提携させる(n)支部,加入者s, said the 明言する/公表する 立法機関 has been ますます 売春婦s tile to abortion 権利s, yet she was uncertain what would happen if 魚の卵 were overturned.

"A 大多数 of Floridians support 接近 to abortion, and don't want to see it go away," she said.

In the 10年間s since the 魚の卵 決定/判定勝ち(する), several 明言する/公表するs have kept or 追加するd anti-abortion 法律s that could 施行される すぐに if the 判決,裁定 were overturned.

の中で them is Wisconsin. Nicole Safar, director of 政府 relations for the 明言する/公表する's Planned Parenthood (v)提携させる(n)支部,加入者, said a 法令 has been on the 調書をとる/予約するs since 1849 making it a 重罪 for a doctor to 成し遂げる an abortion in Wisconsin. Abortion is likely to remain 合法的な in 隣接地の Illinois, but Safar said even that trip might be out of reach for many low-income women in Wisconsin.

"Illinois is and should remain an oasis for abortion care, but we can't be complacent about that," said Brigid Leahy, director of public 政策 for Planned Parenthood in Illinois. "I don't think our 立法機関 is 均衡を保った to pass a 禁止(する) should 魚の卵 be overturned. But things can always change."

Vicki Saporta, 大統領,/社長 of the 国家の Abortion 連合, said a reconfigured 最高裁判所 might 演説(する)/住所 an abortion 事例/患者 by leaving some 面s of 魚の卵 in place, but chipping away at it to 許す a broader 範囲 of 制限s.

"It's not so 平易な to overturn 魚の卵," she said. "Women in this country would not stand for it."

Anti-abortion leader Marjorie Dannenfelser of the Susan B. Anthony 名簿(に載せる)/表(にあげる) also 予報するd that a "chipping away" of 魚の卵 might be more likely than its total 逆転. She said 議会 was likely to pass a 禁止(する) on most abortions after 20 weeks of pregnancy, and 明言する/公表するs would feel more emboldened in passing 堅い anti-abortion 法律s.

"魚の卵 is alread y in shambles," she said.

Carol Tobias, 大統領,/社長 of the 国家の 権利 to Life 委員会, said 魚の卵's 結局の demise would mean even brighter prospects for 明言する/公表する anti-abortion 法律制定.

"Our 明言する/公表する (v)提携させる(n)支部,加入者s have been working to pass 法律s, but they run up against 魚の卵," she said. "If 魚の卵 were overturned, it would 許す us to fight in each 明言する/公表する."

Professor Michael New, an abortion 対抗者 who teaches 経済的なs at Ave Maria University in Florida, said he would welcome a 逆転 of 魚の卵 even if abortion 政策 in many 明言する/公表するs remained 不変の.

"It would 再開する a serious 審議 about sanctity of life 問題/発行するs in the 部隊d 明言する/公表するs," he wrote in an email. "This is a 審議 that プロの/賛成の-lifers welcome."
