Lawyers for ex-警官,(賞などを)獲得するs raise Floyd's history of 罪,犯罪, 麻薬 use

MINNEAPOLIS (AP) - An 弁護士/代理人/検事 for one of four former Minneapolis officers 告発(する),告訴(する)/料金d in George Floyd's death is 最高潮の場面ing Floyd´s past 罪,犯罪s and history of 麻薬 use, calling him an ex-反対/詐欺 and "evident danger to the community." Another is 掴むing on Floyd´s 医療の 問題/発行するs and 中毒, 説 he likely died from fentanyl, not a 膝 on his neck.

Some 法廷,裁判所 filings by 弁護 弁護士/代理人/検事s in 最近の months are taking a 非難する-the-犠牲者 approach. It's a ありふれた 弁護 戦略 that 合法的な 専門家s say will be used to show officers 行為/法令/行動するd reasonably, and to 反対する 広範囲にわたって seen bystander ビデオ showing a white police officer ひさまづくing on Floyd's neck for nearly eight minutes.

専門家s say the 戦略 may resonate with a 可能性のある 陪審/陪審員団 pool, even if much of what is said now never comes up at a 裁判,公判 始める,決める for next spring.

Don 吊りくさび, a 目だつ Twin Cities 弁護士/代理人/検事 who is not connected to this 事例/患者, said it´s not unusual for 弁護 弁護士/代理人/検事s to "料金d the stereotype of the dangers of a 黒人/ボイコット man" to a 陪審/陪審員団 to show that any use of 軍隊 by 法律 施行 is 正当化するd. He said only one or two 賠審員s need to have 疑問s.

Floyd, a 黒人/ボイコット man who was in 手錠s, died May 25 after Derek Chauvin 圧力(をかける)d his 膝 against Floyd´s neck as Floyd said he couldn´t breathe and became motionless. Chauvin is 告発(する),告訴(する)/料金d with second-degree 殺人, third-degree 殺人 and 過失致死. Thomas 小道/航路, J. Kueng and Tou Thao are 告発(する),告訴(する)/料金d with 補佐官ing and abetting both second-degree 殺人 and 過失致死.

Bystander ビデオ of Floyd's 逮捕(する) 循環させるd around the world, 誘発するing 抗議するs and 主要な to 増加するd support for the 黒人/ボイコット Lives 事柄 movement. マイク Brandt, a 弁護 弁護士/代理人/検事 not connected to the 事例/患者, said 反対するing that ビデオ with Floyd's past is good 戦略.

Chauvin is charged with second-degree murder of George Floyd, a black man who died after being restrained by him and the other Minneapolis police officers on May 25. Kueng, Lane and Thao have been charged with aiding and abetting Chauvin. Minneapolis adopted a policy in 2016 requiring officers to intervene when colleagues are using inappropriate force. "You are trying to 押し進める the pendulum 支援する ... from those damning ビデオs of Chauvin with his 膝 on Floyd´s neck," he said.

The former officers are in 法廷,裁判所 Friday for a 審理,公聴会 on several 問題/発行するs, 含むing a 起訴 request to try the men together and 弁護 requests to move the 裁判,公判 away from Minneapolis. 弁護 requests to 解任する 告発(する),告訴(する)/料金s are not 推定する/予想するd to be argued on Friday, によれば an 協議事項 for the 審理,公聴会.

In 文書s requesting 解雇/(訴訟の)却下, 小道/航路's 弁護士/代理人/検事, Earl Gray, wrote about Floyd´s 事前の 告発(する),告訴(する)/料金s of 武装した 強盗 and 麻薬 所有/入手 in Texas. He called Floyd an ex-反対/詐欺, a violent 被告, a liar, an (麻薬)常用者, a 麻薬 distributor, and a danger. "Mr. Floyd was, as the Officers had 嫌疑者,容疑者/疑うd, an (麻薬)常用者," Gray wrote. "He was worse than that."

Ben Crump, an 弁護士/代理人/検事 for Floyd's family, 拒絶するd that approach.

"Everything you need to know is on that horrific ビデオ," Crump said. "When police do inexcusable things, the 弁護 is always to kill the 犠牲者 all over again by dredging up their history and assassinating their character."

The Texas 強盗 is ありそうもない to come up at 裁判,公判 because it wouldn't be 関連した unless the officers had 事前の knowledge of it. Kelly Keegan, another 弁護士/代理人/検事 not connected to the 事例/患者, said 事前の 出来事/事件s can´t be brought up in 法廷,裁判所 just to smear p eople, and a 裁判官 must 重さを計る whether the (警察などへの)密告,告訴(状) will help the 陪審/陪審員団 find facts or just leave a 消極的な impression.

One past 逮捕(する) that could come up at 裁判,公判 is a May 2019 出来事/事件 in which 弁護 弁護士/代理人/検事s say Floyd 行為/法令/行動するd in a 類似の way.

団体/死体-camera (映画の)フィート数 from the day Floyd died shows 小道/航路 and Kueng approaching a panicked Floyd, who says, "I´m not a bad guy!" and struggles, begging not to be put in a squad car. Gray wrote that the ビデオ shows Floyd had something in his mouth that looked like a fentanyl pill, which disappeared. 検視 報告(する)/憶測s show Floyd had fentanyl in his system.

Gray and Eric Nelson, Chauvin's 弁護士/代理人/検事, wrote that during a May 2019 逮捕(する), Floyd wouldn´t listen to officers´ 命令(する)s, put something in his mouth, had to be 肉体的に 除去するd from a 乗り物, then began to cry. In that 事例/患者, several opioid pills were 設立する, along with コカイン, they wrote.

Nelson compared Floyd's 行為 in both 逮捕(する)s, 説: "明確に, Mr. Floyd had a modus operandi in the way he 行為/法令/行動するd when approached by police officers while 試みる/企てるing to 隠す 麻薬s."

Keegan said even if the officers had no knowledge of the 2019 逮捕(する), 弁護 弁護士/代理人/検事s could argue Floyd had a habit of swallowing 麻薬s, 事実上の/代理 脅すd, crying and struggling when approached by police.

Gray wrote that Floyd 株 非難する for his death.

"All he had to do is sit in the police car, like every other 被告 who is 最初 逮捕(する)d," Gray wrote. "While 試みる/企てるing to 避ける his 逮捕(する), all by himself, Mr. Floyd overdosed on Fentanyl. Given his intoxication level, breathing would have been difficult at best. Mr. Floyd´s intentional 失敗 to obey 命令(する)s, coupled with his overdosing, 与える/捧げるd to his own death."

Nelson also honed in on Floyd's past 麻薬 use, 令状ing that bringing up Floyd´s history of 麻薬 中毒 is "not an 試みる/企てる to 攻撃する,非難する Mr. Floyd´s character." But, he said, Floyd most likely died of "fentanyl or a combination of fentanyl and methamphetamine in concert with his underlying health 条件s."

The 郡 医療の examiner 分類するd Floyd's death as a 殺人, with his heart stopping while he was 抑制するd by police and his neck compressed. A 要約 報告(する)/憶測 名簿(に載せる)/表(にあげる)d fentanyl intoxication and 最近の methamphetamine use under "other 重要な 条件s" but not under "原因(となる) of death."

によれば 検察官,検事s' 公式文書,認めるs, Hennepin 郡 医療の Examiner Andrew パン職人 told 検察官,検事s that absent other 明らかな 原因(となる)s of death, it "could be 許容できる" to 支配する the death an overdose, based on the level of fentanyl in Floyd's system. A separate 検視 (売買)手数料,委託(する)/委員会/権限d for Floyd´s family 結論するd he died of asphyxiation 予定 to neck and 支援する compression.

吊りくさび and Keegan said Floyd's 原因(となる) of death will be up to a 陪審/陪審員団. They said it would be 堅い to 除去する all biases from a 可能性のある 陪審/陪審員団, and questions asked during 陪審/陪審員団 選択 will be important.

While a 非難する-the-犠牲者 approach might seem 疑わしい to some, 吊りくさび said a 弁護 弁護士/代理人/検事´s 職業 "is not to foster racial harmony or to その上の 犯罪の 司法(官) 改革(する). His 職業 is 単独で to get his (弁護士の)依頼人 acquitted."
