Speedboat driver (疑いを)晴らすd of 過失致死 after ブイ,浮標 衝突,墜落 killed teenage girl

A speedboat 操縦する has been 設立する not 有罪の of 過失致死 after a 衝突,墜落 with a ブイ,浮標 killed a teenage 乗客.

Emily 吊りくさび, 15, 苦しむd 致命的な 傷害s after the rigid inflatable boat (Rib) 衝突する/食い違うd with the 4.5m high ブイ,浮標 at 36.6 knots in Southampton Water on August 22 2020, with a number of other 乗客s 存在 本気で 負傷させるd.

Michael Lawrence, 55, who was 運動ing the boat, was 設立する not 有罪の of 過失致死 by 重過失, but 有罪の of failing to 持続する a proper 警戒/見張り and failing to proceed at a 安全な 速度(を上げる), by the 陪審/陪審員団.

The 陪審/陪審員団 took nearly 18 hours to 罪人/有罪を宣告する Michael Howley, 52, the owner of Seadogz, the company which operated the boat trip, with not operating the boat 安全に.

Christine Agnew KC, 起訴するing, told the 裁判,公判 at Winchester 栄冠を与える 法廷,裁判所 that Emily’s parents, Simon and Nikki, had decided to take their daughters Emily and Amy, 18, for the “high thrills” speedboat ride.

The rib was 記録,記録的な/記録するd to travel at 速度(を上げる)s of 47.8 knots, which is in 超過 of an 満了する/死ぬd 速度(を上げる) 限界 of 40 knots (46mph) which she said both 被告s believed was still in place.

As part of the ride, which took place in “perfect 条件s”, the Stormforce 950 rib crossed the wake of the Red Falcon フェリー(で運ぶ) five times before it then 長,率いるd straight に向かって the North West Netley ブイ,浮標, which 対策 4.69m above the water line.

The Rib travelled straight に向かって the ブイ,浮標 at a 速度(を上げる) of 36.6 knots for 14 seconds before hitting it, throwing two 乗客s into the water and 負傷させるing several others.

Emily 苦しむd 厳しい 内部の 傷害s after 存在 鎮圧するd against the metal 扱う in 前線 of her.

She was taken 岸に by another Rib and then by 救急車 to hospital.

She died after her family took the 決定/判定勝ち(する) to turn off her life support system after 存在 told by doctors that she had 苦しむd oxygen 餓死 to the brain and her 傷害s were “unsurvivable”.

Ms Agnew said that Lawrence, of Blackfield, New Forest, 最初 said that a 直面する mask had blown into his 直面する 封鎖するing his 見通し but had later changed his account.

The former lifeboatman told the 裁判,公判 that he had lost his 見通し momentarily 事前の to hitting the ブイ,浮標.

Lawrence was said in 法廷,裁判所 to be an “極端に experienced 水夫” and his co-被告 述べるd him as “Mr 安全な and Mr 用心深い”.

同様に as serving as an RNLI lifeboatman for 20 years, he held a number of 資格s and he was also the 主要な/長/主犯 of his own RYA recognised training centre, A2Sea, which held 力/強力にする boat courses.

Howley, of Hordle, New Forest, who is also a former lifeboatman, said that he used his experience on 救助(する)s to 知らせる his 危険 査定/評価s that he carried out for his 商売/仕事 to 確実にする the safety of the 乗客s and staff.

Both men will be 宣告,判決d at the same 法廷,裁判所 on March 17.
