The 法廷,裁判所 of 控訴,上告 is to give its 判決,裁定 in a 合法的な 戦う/戦い over the 権利 to wild (軍の)野営地,陣営 in Dartmoor 国家の Park.

In January, a High 法廷,裁判所 裁判官 結論するd that a nearly 40-year-old piece of 法律制定 did not 供給する people the 権利 to pitch テントs 夜通し on Dartmoor ありふれたs without landowners’ 許可.

農業者s Alexander and Diana Darwall brought a successful 合法的な challenge against the Dartmoor 国家の Park 当局 (DNPA), (人命などを)奪う,主張するing some campers 原因(となる) problems to livestock and the 環境.

The DNPA asked 控訴,上告 裁判官s to overturn Sir Julian Flaux’s 判決,裁定 at a 審理,公聴会 in London earlier this month, arguing he had the wrong 解釈/通訳 of a 1985 法律 over 権利s of 接近 to Dartmoor ありふれたs.

Sir Geoffrey Vos, Lord 司法(官) Underhill and Lord 司法(官) Newey are 予定 to give their 判決,裁定 over the 控訴,上告 on Monday afternoon.

At the 審理,公聴会 before 控訴,上告 裁判官s, the 法廷,裁判所 was told that the 1985 法律 明言する/公表するs that “the public shall have a 権利 of 接近 to the ありふれたs on foot and on horseback for the 目的 of open-空気/公表する recreation”.

Timothy Straker KC, for the DNPA, said the High 法廷,裁判所 裁判官 had “failed… to 高く評価する/(相場などが)上がる that (軍の)野営地,陣営ing is an open-空気/公表する recreation”.

He said Sir Julian was also wrong to find that wild (軍の)野営地,陣営ing ? where backpackers stay 夜通し away from 伝統的な campsite 施設s ? was “a 施設” to enable people to enjoy 引き上げ(る)ing.

The Open Spaces Society (OSS), a 自然保護 charity that 介入するd in support of the DNPA’s 控訴,上告, (人命などを)奪う,主張するd the 判決,裁定 “went too far” and could 影響する/感情 bird-watching, fishing and other activities.

Richard Honey KC, for the OSS, (人命などを)奪う,主張するd that the 裁判官’s 結論s created “不確定” and did not consider the “wider public 利益/興味”.

The barrister said (軍の)野営地,陣営ing is “part-and-parce l” of long-distance walking, 追加するing that birdwatchers, fishers, 激しく揺する 登山者s who use テントs, and walkers 攻撃する,衝突する by bad 天候 could all be 影響する/感情d by the High 法廷,裁判所 判決,裁定.

Tim Morshead KC, …に反対するing the 控訴,上告 for the Darwalls, said (軍の)野営地,陣営ing “is not on any possible 見解(をとる) a form of ‘open-空気/公表する recreation’ in any 状況”, 追加するing that the OSS had “failed to identify any example of any ありふれた on which the public has ever had a 権利 of (軍の)野営地,陣営ing”.

Mr Morshead said Mr?Darwall?was not “the bad guy” in the 事例/患者 and had been “painted as someone 敵意を持った to (軍の)野営地,陣営ing”.

He said there was a “real problem” on Mr Darwall’s land and that it was “not reasonable” for a landowner to give up 支配(する)/統制する over it “without 補償(金)”.

Mr and Mrs Darwall keep cattle on the remote 立ち往生させる Moor which forms part of their more than 3,450-acre 広い地所 in the southern part of Dartmoor.

Dartmoor?国家の Park, 指定するd in 1951, covers a 368-square mile area that features “ありふれたs” ? areas of unenclosed 個人として owned moorland where l ocals can put livestock.

The DNPA 以前 said backpack campers can 接近 nearly 52,000 acres of ありふれた land across the 国家の park and can stay 夜通し under a new “permissive system” as long as they follow a code of 行為/行う.
