訴訟s over Baltimore 橋(渡しをする) 崩壊(する) likely, though 限られた/立憲的な, lawyers say

March 28 (Reuters) - The owner, 操作者 and charterer of the コンテナ ship that struck Baltimore´s Francis Scott 重要な 橋(渡しをする) on Tuesday are likely to 直面する 訴訟s over its 崩壊(する) and the people killed or 負傷させるd, but 合法的な 専門家s say U.S. 海上の 法律 could 限界 the companies´ 義務/負債.

That's because U.S. 法廷,裁判所s have 解釈する/通訳するd a 1927 U.S. 最高裁判所 判決,裁定 to mean that any 純粋に 経済的な 損害賠償金 from 海上の 出来事/事件s can´t be 回復するd from the ship´s owners and 操作者s, Davies and other 専門家s said.

Instead, 訴訟s would be 限られた/立憲的な to 傷害s, death and 所有物/資産/財産 損失 or losses, such as (人命などを)奪う,主張するs from the people 害(を与える)d by the 崩壊(する) or (人命などを)奪う,主張するs over the 損失 to the 橋(渡しをする) itself, likely brought by 政府 (独立の)存在s.

The 訴訟s are likely to be とじ込み/提出するd in 連邦の 法廷,裁判所, the 専門家 s said. The 原告/提訴人s may also ask a 連邦の 裁判官 to "逮捕(する)" the ship, and 妨げる it from leaving the 裁判権 while the litigation plays out, they said.

Those with 経済的な 損害賠償金 might be able to get 補償(金) from 保険 政策s. 保険会社s could 直面する billions of dollars in (人命などを)奪う,主張するs, 分析家s said, with one putting the cost at as much as $4 billion, which would make the 悲劇 a 記録,記録的な/記録する shipping 保険 loss.

Traffic was stopped on Tuesday before the ship, 指名するd the Dali, struck the pylon that led to the 橋(渡しをする)´s 崩壊(する), likely saving lives. But eight people fell into the river, where water 気温s were 47 degrees Fahrenheit (8 degrees Celsius).

The remains of two of the six 行方不明の 労働者s were 回復するd on Wednesday with the remaining four 推定するd dead. Two 労働者s were 救助(する)d, one 無事の and one 負傷させるd. The ship's owner, its 操作者, charterer and even the ship itself could 直面する (人命などを)奪う,主張するs for those 傷害s or deaths.

Under 海上の 法律, a 犠牲者 can 告訴する the ship itself, in contrast to 法律s 付随するing to car 衝突,墜落s, and have it sold to 満足させる their judgment, said Robert Anderson, a professor at the University of Arkansas School of 法律.

But an 1851 法律 限界s the shipowners´ 義務/負債 to the 現在の value of the ship, which could be in tens of millions of dollars, said Anderson and Baltimore 海上の 原告/提訴人s´ 弁護士/代理人/検事 Charles Simmons Jr.

Davies and Simmons said they 推定する/予想する the shipowners to 嘆願(書) a 連邦の 法廷,裁判所 for that 制限 of 義務/負債, and Anderson said the shipowners will likely rely on 義務/負債 保険 to 支払う/賃金 any 損害賠償金.
