With '裁判官s 裁判官ing 裁判官s,' rogues on the (法廷の)裁判 have little to 恐れる

BARTLESVILLE, Oklahoma, July 9 (Reuters) - 地区 法廷,裁判所 裁判官 Curtis DeLapp was renowned for his hair-誘発する/引き起こす temper. Mispronounce his 指名する, come to 法廷,裁判所 a few seconds late, fail to rise as quickly as he´d like - no slight was too small to 始める,決める him off.

For almost a dozen years, DeLapp used his 力/強力にする to terrify people who appeared before him, 圧力(をかける)ing contempt 告発(する),告訴(する)/料金s against 弁護 弁護士/代理人/検事s, 検察官,検事s and even a 見込みのある 賠審員 who brought children to 法廷,裁判所 when she couldn´t find daycare, 法廷,裁判所 記録,記録的な/記録するs show.

Another 賠審員 was 罰金d $340.70 after she 反対するd to how DeLapp was 扱う/治療するing people who appeared before him. "I never want to be a 賠審員 or ever go 支援する to 法廷,裁判所 again," said Carolyn Duffey Love, now 68. "He 扱う/治療するd me like a dog."

In 2015, DeLapp grew incensed when he learned someone had dropped sunflower seeds in his courtroom, によれば 証言,証人/目撃するs. After scouring (映画の)フィート数 from a courtroom 安全 camera, the 裁判官 召喚するd a 観客 to his 議会s, 告発(する),告訴(する)/料金d her with contempt and ordered her 刑務所,拘置所d for four days.

The lawyers also say they worried that crossing DeLapp 危険d 報復 against both them and their (弁護士の)依頼人s.

Not until 2018 - after DeLapp 宣告,判決d courtroom 観客 Randa Ludlow to nearly six months in 刑務所,拘置所 for talking to her boyfriend during 法廷,裁判所 - did 地元の lawyers find the courage to 行為/法令/行動する.

They enlisted a lawyer from 50 miles away who seldom practiced in DeLapp´s courtroom. And they worked collectively to build a voluminous (民事の)告訴 主張するing that DeLapp had unlawfully 刑務所,拘置所d not just Ludlow but also many dozens of peo ple in the 事前の two years alone. In leaving the (法廷の)裁判, DeLapp became one of at least 341 裁判官s across the 部隊d 明言する/公表するs to escape 罰 or その上の 調査 in the past dozen years by 辞職するing or retiring まっただ中に 不品行/姦通 主張s, Reuters 設立する.

The DeLapp 事例/患者 向こうずねs a light on one of the most opaque and 活動停止中の judicial disciplinary systems in America. In Oklahoma, repercussions for 悪事を働くこと have been so ありそうもない that 裁判官s could behave with impunity.

Although each U.S. 明言する/公表する has a judicial oversight 機関 to 審査する and 調査/捜査する 不品行/姦通 (民事の)告訴s, their 力/強力にするs are often 限られた/立憲的な. In most 明言する/公表するs, the ultimate disciplinary 当局 over a 裁判官 残り/休憩(する)s with other 裁判官s.

In Oklahoma, the 裁判長 (権力などを)行使するs enormous discretion over judicial 不品行/姦通 事例/患者s. After the 明言する/公表する´s 会議 on Judicial (民事の)告訴s 完全にするs a confidential 調査 of a (民事の)告訴 about a 裁判官, the 裁判長 has the 力/強力にする to 扱う discipline 個人として - except in rare 事例/患者s serious enough to 正当化する 除去するing the (刑事)被告 裁判官 from the (法廷の)裁判.

During their 任期s, two former 明言する/公表する 最高の 法廷,裁判所 裁判長s told Reuters, about one or two wayward 裁判官s a year were 静かに s ummoned to the 最高の 法廷,裁判所. There, they received a tongue-攻撃するing behind the の近くにd doors of the 裁判長´s 議会s. No 公式の/役人 記録,記録的な/記録する was kept of those 会合s, the 司法(官)s said.

As former 長,指導者 司法(官) Joseph ワット put it: "I´d much rather woodshed my brethren in 私的な and not in public." He 追加するd: "How does that 裁判官 feel, knowing he´s 存在 taken to the woodshed in 前線 of God and everybody?"

This practice - 法律 professor Stephen Gillers calls it "裁判官s 裁判官ing 裁判官s" - 土台を崩すs the system´s ability to 妨げる 不品行/姦通 on the (法廷の)裁判.

Gillers said the 殺人,大当り of George Floyd, the 黒人/ボイコット man who died in May under the 膝 of a Minneapolis police officer, has 燃料d 関心s about how judicial 不品行/姦通 is 扱うd, too. "The public has been 警報d as it never has been before to the way police 不品行/姦通 is 隠すd," said Gillers. "The same is true for 裁判官s."

When 裁判官s are the ones 評価するing 不品行/姦通 by other 裁判官s, they "tend to be more 同情的な, more understanding, more 許すing" to their own, said Gillers, a scholar on judicial 倫理学 who teaches at New York University.

Privacy also 略奪するs the system of a deterrent 影響: 隠すing the 罰 fails to discourage bad 行為/行う by other 裁判官s, who may never learn of the consequences, Gillers and other ethicists say.

In its 調査 into judicial 不品行/姦通 across America, Reuters sought to quantify the personal (死傷者)数 (打撃,刑罰などを)与えるd by 裁判官s who break the 法律 or 侵害する/違反する their sworn 誓いs. Over a dozen years, Reuters 設立する at least 5,206 people who were 直接/まっすぐに 影響する/感情d by a 裁判官´s 不品行/姦通. The 犠牲者s 範囲d from individuals who were 支配するd to 人種差別主義者, sexist and other abusive comments from 裁判官s to those 不法に 刑務所,拘置所d.

"This is a broken system that 絶対 権力を与えるd 裁判官s like DeLapp to operate with impunity," said Josh 物陰/風下, the out-of-town 弁護士/代理人/検事 who led the 成果/努力 to rein in DeLapp. "For more than a 10年間, not a 選び出す/独身 裁判官 was 公然と disciplined. What 肉親,親類d of message does that send?" 物陰/風下 said that DeLapp "had no 推論する/理由 to 恐れる that anyone would stop him."

MASKING MISCONDUCT

Reiko Callner, the (売買)手数料,委託(する)/委員会/権限's (n)役員/(a)執行力のある director, said 裁判官s should be 扱う/治療するd the same as anyone who appears before them.

"The norm is that anything that happens in a 法廷,裁判所 has the 指名する of the 関係者s on it - the 指名するs of a 犯罪の 被告, the 罪,犯罪 犠牲者, people 伴う/関わるd in a 訴訟," Callner said. "Why should a 裁判官 who has been 設立する to have 侵害する/違反するd the code that 治める/統治するs their 行為/行う be 許すd to keep that fact from the public?"

Many 明言する/公表する (売買)手数料,委託(する)/委員会/権限s say there are sound 推論する/理由s to discipline 裁判官s 個人として. "It´s quick, it´s 安価な and you don´t have to 持つ/拘留する a public 審理,公聴会," said Cynthia Gray, director of the 中心 for Judicial 倫理学 at the 国家の 中心 for 明言する/公表する 法廷,裁判所s, an 独立した・無所属 nonprofit 研究 and training organization.

Often, Gray said, 明言する/公表するs see 利益s to keeping 事柄s confidential. "If it´s on e-time, minor 不品行/姦通 by a 裁判官, and the 裁判官 shows 悔恨, you can 問題/発行する a 私的な 許可/制裁 or letter and then move on," she said. That means (売買)手数料,委託(する)/委員会/権限s can 焦点(を合わせる) "on the 裁判官s who are out there committing patterns of 不品行/姦通 and are fighting every step of the way."

Still, a Reuters 調査 設立する that 私的な discipline has been used to mask 重要な 違反s of the 法律. For example, in 2018, 明言する/公表する 記録,記録的な/記録するs show, a Texas 裁判官 failed to "持続する professional competence" and 不法に 刑務所,拘置所d indigent 被告s. And in 2017, a California 裁判官 engaged in 性の いやがらせ and showed a "欠如(する) of candor" when (刑事)被告 of 不品行/姦通, 記録,記録的な/記録するs show. Neither their 指名するs nor their 罰s have been made public.

In Colorado, the judicial (売買)手数料,委託(する)/委員会/権限 has 公然と disciplined four 裁判官s since 2008 but has 個人として 許可/制裁d 52. の中で those whose 指名するs and other identifying (警察などへの)密告,告訴(状) remain hidden from the public: 裁判官s disciplined for 性の いやがらせ, for 酔っ払い運転, for 延期するd 判決,裁定s, and for 論証するing a "pattern of errors in 扱うing 裁判,公判s or 問題/発行するing 判決,裁定s that 示す a 欠如(する) of competence."

A Reuters examination of judicial 不品行/姦通 国家的に identified 3,613 事例/患者s from 2008 through 2018 in which 明言する/公表するs disciplined 裁判官s in 私的な, 保留するing from the public 詳細(に述べる)s of their 罪/違反s - 含むing the 身元s of the 裁判官s themselves.

Over the same period, 26 明言する/公表する oversight 会議s 解決するd more judicial 不品行/姦通 事例/患者s 個人として than 公然と, the news 機関 設立する. In Massachusetts, for instance, reviews of judicial 行為/行う (売買)手数料,委託(する)/委員会/権限 年次の 報告(する)/憶測s show that about 9 in 10 裁判官s disciplined were 個人として 許可/制裁d.

Some judicial oversight 機関s take their independence and secrecy to extremes.

California´s oversight 機関 went to 法廷,裁判所 to try to 妨げる an audit of its 記録,記録的な/記録するs, a review that 最終的に discovered sloppy 調査s of 裁判官s. In Illinois, th e 機関 misplaced or lost hundreds of (民事の)告訴s, which have not been 回復するd or 調査/捜査するd.

Kathy Twine, who directs the Illinois Judicial 調査 Board, 拒絶する/低下するd to comment on the lost とじ込み/提出するs. Twine also would not 供給する 決まりきった仕事 (民事の)告訴 and 調査 統計(学) to Reuters - 統計(学) 公表する/暴露するd to the news 機関 by almost every other 明言する/公表する."We´re like an island," the 公式の/役人 said. "We don´t have to 公表する/暴露する anything."

A comparison between Oklahoma and a 明言する/公表する of 類似の size 最高潮の場面s the discrepancies in how 裁判官s are 扱う/治療するd.

From 中央の-2004 to 中央の-2018, Oklahoma did not とじ込み/提出する 不品行/姦通 告発(する),告訴(する)/料金s against any of its 600 裁判官s, Reuters 設立する. By contrast, the 明言する/公表する of Mississippi - with 事実上 the same code of judicial 行為/行う and almost the same number of 裁判官s - 公然と 許可/制裁d 75 裁判官s in the same period.

"I´m sure every 明言する/公表する would like to think it has a 司法の that is above reproach, but every profession´s going to have a few bad apples," said Darlene Ballard, who retired last week as director of the Mississippi (売買)手数料,委託(する)/委員会/権限. "It sounds like other 明言する/公表するs like to keep their problems in-house so that it appears to the public that they don't have any bad 裁判官s."

Steve Scheckman, who 調査/捜査するd 不品行/姦通 事例/患者s in Louisiana and New York, said 明言する/公表するs that 報告(する)/憶測 so few 事例/患者s are failing in their 最初の/主要な 使節団: to defend, before the public, the 正直さ of the 司法(官) system.

"To think that there´s no 不品行/姦通 in your 明言する/公表する, you´re either really naive, in 否定 or 保護するing people," he said.

Former Oklahoma 司法(官) Steven Taylor 論争s such characterizations. Taylor, who served on the 明言する/公表する´s 最高の,を越す 法廷,裁判所 from 2004 through 2016, said he was proud that the 明言する/公表する had so few 事例/患者s of public discipline. To him, the small number of 事例/患者s doesn´t 論証する weak oversight. It shows "a 司法の in Oklahoma that is 倫理的な, doing their work and 高度に disciplined."

"If we had 6o or 70 事例/患者s, I would be ashamed or embarrasse d," Taylor said.

As 裁判長 in 2011 and 2012, Taylor 解任するd, he visited the Washington 郡 courthouse in Bartlesville, where he met 裁判官 DeLapp and others. Taylor said no one について言及するd any 関心s about how DeLapp ran his courtroom.

But Reuters identified 得点する/非難する/20s of contempt 告発(する),告訴(する)/料金s 問題/発行するd by DeLapp in traffic and other 事例/患者s before, during and after Taylor´s time 主要な the (法廷の)裁判. Some 時代遅れの 支援する a 10年間. Taylor said he was "極端に disappointed" when he heard in 2018 that DeLapp had 行為/法令/行動するd so inappropriately for so many years. He also was surprised that lawyers had remained silent for so long.

"Why didn't someone 報告(する)/憶測 this?" the former 司法(官) asked. The 地元の lawyers who kept 静かな for years 申し込む/申し出 a simple answer, rooted in the 明言する/公表する´s 願望(する) to keep judicial 不品行/姦通 secret: An unchecked 裁判官 has the ability to cow his community.

In Bartlesville, the Washington 郡 seat, four 裁判官s hear 犯罪の and civil 事例/患者s, with traffic infractions 代表するing the 本体,大部分/ばら積みの. The city of 36,000 is an hour north of Tulsa. The courthouse is convenient for 訪問者s, who park for 解放する/自由な just steps from the 入り口. It also is an 平易な place for a 裁判官 to escape scrutiny.

That´s because in Washington 郡 and thousands of other courtrooms 国家的に, there is no 必要物/必要条件 to 記録,記録的な/記録する or transcribe most 訴訟/進行s. 雇うing a stenographer or 記録,記録的な/記録するing the 訴訟/進行s is considered too expensive and 大部分は unnecessary for the 議会-line pace of 軽罪 事例/患者s that (不足などを)補う most of the 法廷,裁判所´s 商売/仕事.

This 欠如(する) of an 公式の/役人 and 詳細(に述べる)d 記録,記録的な/記録する 提起する/ポーズをとるd an 障害 to the 地元の 弁護士/代理人/検事s alarmed by DeLapp´s 行為. Absent transcripts or recordings to 確認する their 関心s, six lawyers told Reuters, they worried that a (民事の)告訴 allegin g 不品行/姦通 would come 負かす/撃墜する to their word against the 裁判官´s.

The 地元の lawyers say they felt 攻撃を受けやすい to 報復. DeLapp (権力などを)行使するd 当局 to 任命する 弁護士/代理人/検事s to 事例/患者s 伴う/関わるing indigent 被告s. They say the per diem 支払う/賃金 for this work made the difference for some lawyers between insolvency and eking out a living.

That explanation bothers Taylor, the former 明言する/公表する high 法廷,裁判所 司法(官). "It's sad that the lawyers were 脅迫してさせるd," Taylor said. "Part of the hallmark of 存在 a lawyer is speaking truth to 力/強力にする. They should have spoken up."

But many of those lawyers say they weren´t 簡単に 関心d about themselves. They worried that, if DeLapp got 勝利,勝つd of a (民事の)告訴, he might take it out on 被告s 同様に. "It´s not just your 暮らし at 火刑/賭ける. It´s also (弁護士の)依頼人s," said 弁護 弁護士/代理人/検事 Marty Meason, who practiced before DeLapp and once ran unsuccessfully against him for 地区 裁判官. "Nobody 手配中の,お尋ね者 to take on the system."

That changed in 早期に 2018, when DeLapp ordered Randa Ludlow 刑務所,拘置所d for five months and 27 days in 刑務所,拘置所. Her 申し立てられた/疑わしい 罪/違反: talking during 法廷,裁判所 with her boyfriend, a traffic 被告. Ludlow 拒絶する/低下するd to comment.

The 宣告,判決 seemed outlandish to Meason and other lawyers who had questioned DeLapp´s 行為 for years. They also believed he´d failed to 適切に 文書 his 推論する/理由s for 刑務所,拘置所ing her. Whether DeLapp followed proper 手続き in punishing Ludlow would become a 重要な 構成要素 in the 不品行/姦通 (民事の)告訴 against him.

A few days after Ludlow was 刑務所,拘置所d, the lawyers decided to reach out to 物陰/風下, an 弁護士/代理人/検事 whose office was about an hour's 運動 from Bartlesville - and thus had いっそう少なく to 恐れる because he didn´t 定期的に appear before DeLapp.

物陰/風下 remembers the call his 会社/堅い received from a Washington 郡 lawyer. The message was (疑いを)晴らす: You have to help us stop this 裁判官.

"Everyone 恐れるd 報復," 物陰/風下 said. "I worked far enough away that I might be 安全な. 加える, I was the only one crazy enough to do it."

A DISPUTED DOCUMENT

About seven weeks after DeLapp had 刑務所,拘置所d Ludlow for contempt, 物陰/風下 sought her 解放(する) by とじ込み/提出するing a 令状 of 人身保護(令状) with the 明言する/公表する 最高の 法廷,裁判所 challenging her 拘留,拘置. The high 法廷,裁判所 quickly heard the 事例/患者 in Oklahoma City.

At the 審理,公聴会, DeLapp told the 法廷,裁判所 that he had been unable to 位置を示す the 明確な/細部 文書 合法的に necessary to 刑務所,拘置所 Ludlow. In the 文書, called a Contempt 法廷,裁判所 Minute, 裁判官s must lay out the 合理的な/理性的な for the order. The 文書 must also be time stamped and 調印するd.

The 事例/患者 as it 関係のある to Ludlow was over. When DeLapp produced the 行方不明の Contempt 法廷,裁判所 Minute, the 文書 seemed 半端物, 物陰/風下 解任するd.

It 含むd a stamp that made no sense. It was 時代遅れの two days before DeLapp (人命などを)奪う,主張するd to have created the 文書. In other words, it appeared to be backdated, and 貧しく at that.

物陰/風下 wondered: Had DeLapp 捏造する,製作するd the 文書 because one had never been とじ込み/提出するd in the first place? In late March, 物陰/風下 received a call from Meason, the Bartlesville 弁護士/代理人/検事 who was 静かに helping him build a 不品行/姦通 事例/患者 against DeLapp and harbored 類似の 疑惑s.

"I 設立する the 証拠," Meason 解任するd telling 物陰/風下. "We´ve got him."

DeLapp, Meason explained, had often used 安全 cameras to 監視する the 行為/行う of people in the courthouse. He had used (映画の)フィート数 from one camera to identify the sloppy sunflower-seed eater.

There was also a 安全 camera in the clerk´s office. Pl aying a hunch, Meason went to the 郡保安官´s office and requested a copy of weeks of ビデオ beginning in February 2018. To his surprise, he said, a スタッフの一員 quickly 手渡すd over the (映画の)フィート数 on a flash 運動.

Reuters reviewed the ビデオ, which has never been made public. It shows DeLapp leaving the clerk´s office with とじ込み/提出するs. A clerk then leaves her desk. She returns later with what appears to be a 選び出す/独身-page 文書. The clerk 診察するs the page, then stamps it in two places.

Meason and 物陰/風下 say they were 納得させるd that the 文書 shown on the 安全 tape was the same Contempt 法廷,裁判所 Minute that DeLapp submitted later that day to the high 法廷,裁判所. In the 嘆願(書), the 裁判長 (刑事)被告 DeLapp of "甚だしい/12ダース neglect of 義務," "圧迫 in office" and "完全にする 無視(する)" for the 法律. The 司法(官) also 非難するd DeLapp for 乱用ing his judicial 力/強力にする and 宣言するd him unfit for office.

In a section 肩書を与えるd "Falsified 法廷,裁判所 文書s and Misrepresentation," 徹底的に捜すs chastised DeLapp for "甚だしい/12ダース misrepresent ation" of the 法廷侮辱(罪) 文書. If DeLapp created the 文書 and pretended it was "newly discovered," it may have 構成するd "a grossly intentional misrepresentation to the Oklahoma 最高裁判所" - one that could be construed as a 重罪.

This was not the first time that DeLapp had failed to 適切に とじ込み/提出する a 法廷侮辱(罪) 文書, then produced it after the fact, 徹底的に捜すs 結論するd. Rather than fight the 不品行/姦通 主張s, DeLapp 辞職するd without admitting to any 悪事を働くこと.

Not every 明言する/公表する is 許すing of 裁判官s 直面するing 不品行/姦通 告発(する),告訴(する)/料金s who 選ぶ to 辞職する. California, Texas and a dozen other 明言する/公表するs have 追求するd disciplinary 事例/患者s and 課す 許可/制裁s even after 裁判官s leave the (法廷の)裁判.

West Virginia is の中で them. On 普通の/平均(する), West Virginia disciplines about four or five 裁判官s each year. Often, one or two of these 事例/患者s 伴う/関わるs a 裁判官 who 辞職するd during a 不品行/姦通 調査, said Teresa Tarr, counsel for the 明言する/公表する´s judicial oversight (売買)手数料,委託(する)/委員会/権限.

"It would be very 平易な for us to 解任する 事例/患者s if they 辞職する," Tarr said. "I think the 権利 thing to do is to 持つ/拘留する them accountable, because it gives the public t he understanding that the 司法の as a whole is not going to 許容する misbehavior. It also lets the other 裁判官s know what´s 許容できる 行為/行う and what´s not."

Not so in Oklahoma, where the 焦点(を合わせる) is on 保護するing the 裁判官, not 知らせるing the public. "We want to try to self-police," said ワット, the former 裁判長. 扱うing 事柄s 非公式に is "the best way to take care of" wayward 裁判官s, "and not drag them through the mud."

解決/入植地 協定s like the one Oklahoma 認可するd for DeLapp do more than 許す (刑事)被告 裁判官s to walk away without admitting 犯罪. When an (刑事)被告 裁判官 leaves the (法廷の)裁判, the (売買)手数料,委託(する)/委員会/権限´s 調査 into misdeeds ends - even if other 悪事を働くこと is 嫌疑者,容疑者/疑うd.

Because 明言する/公表する judicial 調査s are 調印(する)d, the public is left to wonder about a 裁判官's culpability. 可能性のある 犠牲者s of 不品行/姦通 may go undiscovered. And (売買)手数料,委託(する)/委員会/権限 公式の/役人s are 禁じるd from discussing 事例/患者s under 刑罰,罰則 of 法律. That silence can 権力を与える an (刑事)被告 裁判官 to 宣言する his or her innocence without 国民s ever knowing the facts of the 事例/患者.

DeLapp 辞職するd to 保存する his 暮らし, his wife 地位,任命するd on Facebook. "He could´ve fought it, which he 手配中の,お尋ね者 too but did not want to 危険 losing his 退職, 年金, 妨げる/法廷,弁護士業 license, etc.," she wrote.

In one of his last 行為/法令/行動するs as a 裁判官, DeLapp 問題/発行するd a 声明 in which he 賞賛するd his judicial 業績/成就s and said he was leaving the (法廷の)裁判 with "a 激しい heart but (疑いを)晴らす 良心."
