NEW YORK, Sept 10 (Reuters) - A パネル盤 of 裁判官s on Thursday 宣言するd unlawful a 指示的な from 大統領 Donald Trump to 除外する people who are in the 部隊d 明言する／公表するs 不法に from 代表 when apportioning congressional seats.
The 決定／判定勝ち（する） by a three-裁判官 パネル盤, which could be 控訴，上告d to the U.S. 最高裁判所, is a victory for the 38 明言する／公表するs, cities and 郡s, 加える several 移民，移住（する）s 権利s nonprofits, that 告訴するd over the July 21 指示的な.
The mostly Democratic-leaning 原告／提訴人s, led by New York 明言する／公表する, （刑事）被告 the 共和国の／共和党の 大統領，／社長 of having a "xenophobic" 目的 in 押し進めるing an 憲法違反の 指示的な that 反映するd "差別的な animus" toward Hispanics and other 移民，移住（する） communities.
They said the 指示的な could leave several million people uncounted and 転換 a few 衆議院 seats, with California, Texas and New Jersey most likely to 苦しむ losses.
In its 86-page 決定／判定勝ち（する）, the パネル盤 said Trump 越えるd his statutory 当局 in ordering the 指示的な.
It said 連邦の 法律 要求するd the use of one 始める，決める of numbers to count people for 国勢（人口）調査 and apportionment 目的s, and that so long as they resided in the 部隊d 明言する／公表するs, "違法な 外国人s qualify as 'persons in' a '明言する／公表する'" who should be counted.
"The 大統領 must 行為／法令／行動する in 一致 with, and within the 境界s of, the 当局 that 議会 has 認めるd," the パネル盤 said. "We 結論する that the 大統領 did not do so."
The White House and the Department of 商業, which 監督するs the 国勢（人口）調査, did not すぐに 答える／応じる to requests for comment.
Thursday's 決定／判定勝ち（する） is a fresh 国勢（人口）調査-関係のある 合法的な 後退 for Trump, who has made 抑制（する）ing 移民／移住 a 焦点（を合わせる） of his 大統領／総裁などの地位 and reelection （選挙などの）運動をする.
His 指示的な （機の）カム one year after the 最高裁判所 封鎖するd his 試みる／企てる to 追加する a 市民権 question to the 国勢（人口）調査.
"大統領 Trump's repeated 試みる／企てるs to 妨げる, impair, and preju dice an 正確な 国勢（人口）調査 and the その後の apportionment have failed once again," New York 司法長官 Letitia James said in a 声明.
In defending the 指示的な, 政府 lawyers said Trump had 幅の広い discretion to decide who to count, and that any 害（を与える） was 思索的な.
