Former London art 売買業者 Barnes Thomas, 29, appeared as a contestant on 耐える Grylls' 生き残り 技術s show 'The Island' in 2018 before setting himself up as a 農業者 in the idyllic Cornish hamlet of St Just.
But Mr Thomas - who 述べるd himself as maybe 'the most hated man' in the village - soon 設立する himself locked in a 'bitter' 隣人s' 列/漕ぐ/騒動 with birds-of-prey-産む/飼育するing brothers, ツバメ Nicholas 32, and Scott Nicholas, 31.

'Mr Thomas himself 受託するd that, before they fell out, he had told ツバメ and (his wife) Karen Nicholas in October 2020 that he may have been the most hated man in Mousehole - he had 以前 lived in Mousehole - and went on to say that he may now be the most hated man in St Just,' he said.
'This was a 言及/関連 to Mr Thomas pre-empting the switching on of the village's Christmas lights in Mousehole by him and his 即座の 隣人s illuminating their own decorations の直前に the village switch-on after a 十分な countdown.'

同様に as 過度の noise from his land, he was also (刑事)被告 of stacking silage bales in such a a way as to 封鎖する Scott Nicholas' sea 見解(をとる)s from his home.
Mr Thomas also complained of 'たびたび(訪れる) 行為/法令/行動するs of いやがらせ,' complaining that Scott had destroyed 調印するs and shouted 積極性 at him, while he had also been chased in a 先頭 by one of the brothers' 従業員s.
The brothers 告訴するd for nuisance and 怠慢,過失, arguing that noisy work on Mr Thomas' land during their birds' 産む/飼育するing seasons had 原因(となる)d the death of three birds, 減ずるd 全体にわたる 産む/飼育するing and also resulted in egg loss, with some birds 損失ing them.
For three days, a JCB bucket had at one point been raised in the birds' line of sight, which Scott Nicholas said had 原因(となる)d them to 'go mental at the sight of this 外国人 反対する.'

Giving judgment on the nuisance and 怠慢,過失 (人命などを)奪う,主張するs, 裁判官 Russen said he was 納得させるd that the 活動/戦闘s of Mr Thomas and his company, Upper Cot 広い地所 Ltd (UCE), had 原因(となる)d the three birds' deaths.
'On my 査定/評価 of the 証拠, Mr Thomas was made aware that March to the beginning of June was the time to 避ける 過度の noise and visual 騒動s 近づく the aviary,' he said.

He said he had 見解(をとる)d ビデオs taken in May within the incubation room of the brothers' aviary while building work was done on Mr Thomas' barn, which showed the 'noise upsetting the birds.'
'These activities, 関係のある to the building of the barn, cannot be said to be outside the ordinary and ありふれた use of 農業の land - but they were carried out without proper consideration of Raptors of Penwith's 産む/飼育するing season,' he said.
In relation to the raising of the digger bucket, he 追加するd: 'For the 目的 of 現地視察 by an engineer, the bucket was raised.
'With the bucket raised next to the aviary for those three days, the machine broke the line of sight of at least some birds in the western pens.
'Scott's 証拠 was that the birds were 'going mental' at the sight of this 外国人 反対する.
'Placing the digger on the birds' line of sight on 7 April, 2022, was 完全に at 半端物s with 確実にするing that no undue inconvenience was 原因(となる)d to Raptors of Penwith.'
However, he went on to find it was not proven that the 活動/戦闘s on Mr Thomas' land 伴う/関わるd 'malice, as …に反対するd to carelessness.'
'That 反映するs my 査定/評価 of Mr Thomas's 証拠 taken as a whole. The activity which gives rise to those findings was farming or farm-building 関係のある activity,' he said.
'Even though malice has not been 設立するd, the proven 行為/法令/行動するs of nuisance are in my judgment actionable because they were undertaken without proper consideration of the sensitivity of ROP's birds during the 産む/飼育するing season.
'Mr Thomas was 以前 aware of the need to 避ける 騒動s during the 産む/飼育するing season, and appears to have 受託するd that could be done, and yet the activities were undertaken regardless.
'I also find that those same tortious 行為/法令/行動するs under the 法律 of nuisance support a finding of 怠慢,過失.'
In relation to the いやがらせ (人命などを)奪う,主張するs, the 裁判官 設立する that the brothers knew Mr Thomas ーするつもりであるd to have a peacock house on his land and that they had to be 限定するd 予定 to bird flu 制限s.
'As Scott 確認するd, because the peacocks were killed soon after their arrival they were not there long enough to 原因(となる) a problem,' he said.
'The factual 主張 of stacking of silage bales has been 証明するd - and not 論争d - but I do not 受託する this was an 行為/法令/行動する of いやがらせ, done with the 目的 of 封鎖するing a sea 見解(をとる) from Scott's family home,' he 追加するd.
In relation to Mr Thomas' (人命などを)奪う,主張するs, he 設立する it 'not proven' that anything 量d to いやがらせ, 含むing 'the hot 追跡 示唆するd by Mr Thomas.'
He 拒絶するd the いやがらせ 損害賠償金 (人命などを)奪う,主張するs, but ordered that Mr Thomas and his company are liable to 支払う/賃金 the Nicholas brothers' company £ 258,500 損害賠償金 for the 衝撃 on their birds.
