A Kentucky man who is 告訴するing his 外科医 for amputating part of his penis without his 同意 was at the Kentucky 法廷,裁判所 of 控訴,上告s this week to argue his 事例/患者 その上の.

In 2007, Phillips Seaton of Waddy, lay on Dr John Patterson's operating (米)棚上げする/(英)提議する for a 手続き ーするつもりであるd only as a circumcision to 扱う/治療する an inflammation.

But during the 外科 when the doctor discovered a cancerous growth, he took 活動/戦闘 to 除去する it along with part of Seaton's 組織/臓器, relying on what Seaton's lawyer believes is a 'vague' 医療の 権利放棄 調印するd by a man who 明確に did not understand it.

Kevin George told the 控訴,上告s パネル盤 that the 医療の 権利放棄 調印するd by his (弁護士の)依頼人 含む/封じ込めるs 極端に 幅の広い language and that Dr. John Patterson should have sought 同意 before 除去するing the penis.

'The point is... a 患者 has a 権利,' George said. 'The doctor does not have the 権利 to do whatever he wants, even if it turns out to be reasonable.'

裁判官s Janet Stumbo and Donna Dixon took in the 30 minutes of arguments in Frankfort over whether a 裁判官 err ed in the 陪審/陪審員団 指示/教授/教育s and if the pre-外科 医療の 同意 form was valid or the language in it 証明するd to be too vague.

裁判官 Michael Caperton 行方不明になるd the arguments. Stumbo said Caperton 誤った went to Louisville for the 事例/患者, but would listen to a 記録,記録的な/記録するing of it later.

Confident: Attorney Clay Robinson speaks with Dr John Patterson after jury selection last year ahead of this week's appeal by Seaton's lawyer

確信して: 弁護士/代理人/検事 Clay Robinson speaks with Dr John Patterson after 陪審/陪審員団 選択 last year

Stumbo said a 決定/判定勝ち(する) is 推定する/予想するd in about two months.

Patterson, a Kentucky-based urologist, 持続するs he 設立する 癌 in the man's penis during 外科 and that it had to be 除去するd. The 患者 (人命などを)奪う,主張するs the 外科 was supposed to be a circumcision and he never 権限を与えるd the amputation, nor was he given a chance to 捜し出す a second opinion.

The Seatons 告訴するd Patterson in Shelby 郡 回路・連盟 法廷,裁判所 in 2008 after an 操作/手術 that resulted in the amputation. Seaton, now in his 60s, was having the 手続き on Oct. 19, 2007, to better 扱う/治療する inflammation.

The Seatons also 告訴するd ユダヤ人の Hospital, where t he 外科 took place. The hospital settled with the Seaton and his wife, Deborah, for an 公表されていない 量.

Seaton, 冒険的な glasses and a long, gray and white ponytail, sat 静かに as the 弁護士/代理人/検事s recounted the 詳細(に述べる)s of the 事例/患者 and argued over whether the 裁判官’s 判決,裁定s and the 陪審/陪審員団's 結果 were 訂正する.

'No comment 権利 now,' Seaton said as he left the courtroom.

Both 味方するs of the 事例/患者 agree that Seaton had 癌 in his penis, but the main point of 論争 is over whether Patterson 行為/法令/行動するd reasonably in 除去するing the 組織/臓器 or could amputation have been 延期するd to give Seaton time to 捜し出す other 医療の 選択s.

Clay Robinson, the 弁護士/代理人/検事 for Patterson, 公式文書,認めるd that Seaton, although he (人命などを)奪う,主張するd to be mostly 無学の, 調印するd two separate 同意 forms before the 外科. When Patterson started the surgical 手続き, he 設立する no living tissue, instead 明らかにする/漏らすing a 癌-riddled 組織/臓器 that needed 除去, Robinson said.

'This 事例/患者 isn't about a man's penis 存在 r emoved, it's about 癌 存在 除去するd,' Robinson said.

Stumbo 公式文書,認めるd that Patterson, after finding the 癌, didn't momentarily 停止(させる) the 外科 and 捜し出す the 同意 of Deborah Seaton, who was outside the operating room.

Robinson said the couple had been separated at the time of the 手続き.

'She was not 指定するd as a 医療の 決定/判定勝ち(する) 製造者 for Mr. Seaton,' Robinson said.

George 公式文書,認めるd that Seaton 調印するd the two 同意 forms in the days before the 外科, but said his (弁護士の)依頼人 was 基本的に 無学の and didn't ーするつもりである to give Paterson 同意 to amputate, only 行為/行う a circumcision. Stumbo appeared to agree.

'I noticed these were very, very, very 幅の広い 指示/教授/教育s,' Stumbo said.

Dixon asked why Patterson felt it was necessary to amputate as much of the penis as he did.

'Is there another 手続き... he could have had that would have meant he wouldn't have had to have part of his penis 除去するd?' Dixon said.

'The direct answer is, no,' Robinson replied. 'The 除去 of the 癌 did not 妨げる his having his penis 再建するd.'

Stumbo, though, seemed troubled by Patterson’s 決定/判定勝ち(する) to amputate the penis without 捜し出すing その上の 同意 to do so or giving Seaton an 適切な時期 to 調査する other 選択s.

'Was it truly an 緊急?' Stumbo asked. 'That's the question.'
