Living wills ? the 文書s by which 猛烈に sick 患者s can give 前進する orders to doctors to end their lives ? must no longer be obeyed by the 医療の profession, 裁判官s have ordered.

They have 宣言するd that no one who is in a 昏睡 or an unconscious 明言する/公表する should be 許すd to die without the 事例/患者 first 存在 considered by a 法廷,裁判所.

The 指示/教授/教育s 始める,決める out by 裁判官s of the 法廷,裁判所 of 保護 効果的に strike 負かす/撃墜する the 2005 Mental Capacity 行為/法令/行動する.

Under a living will, people can 教える doctors to 身を引く their 医療の 治療 if they become incapacitated and unable to make 決定/判定勝ち(する)s for themselves.

This means that doctors should 除去する tubes 供給するing them with nourishment and fluids, because in 法律 人工的な 栄養 and hydration counts as 治療. The incapacitated 患者 then dies of hunger and かわき.

It means doctors?should remove tubes providing patients with nourishment and fluids, because in law artificial nutrition and hydration counts as treatment?

医療の staff who ignore a living will and continue to keep their 患者 alive can because of the 行為/法令/行動する be 起訴するd for 強襲,強姦 and sent to 刑務所,拘置所.

The 2005 Mental Capacity 行為/法令/行動する, 非難するd by critics as a 法律 for 安楽死 by the 支援する door, gave 合法的な 軍隊 to living wills and made it a 犯罪の offence for doctors to disobey them.

But the practice directions now 始める,決める 負かす/撃墜する by 大統領 of the Family 分割 Sir James Munby mean people who 令状 living wills, also known as 前進する 指示的なs, can no longer be 保証するd that they will be 許すd to die in line with their 指示/教授/教育s.

The 判決,裁定 by Sir James ? which was 是認するd last week by another 上級の 法廷,裁判所 of 保護 裁判官 ? drew a furious 返答 from the Lord (ドイツなどの)首相/(大学の)学長 who drew up the Mental Capacity 行為/法令/行動する and 操縦するd it through 議会.

Former Lord (ドイツなどの)首相/(大学の)学長 Lord Falconer said: 'My (疑いを)晴らす 見解(をとる) is that what 議会 ーするつもりであるd was that, 支配する to strict 保護(する)/緊急輸入制限s, as long as the person meant it, then 前進する 指示的なs should be given 影響. The 行為/法令/行動する does not 想像する a judicial input.

'That is what I would 推定する/予想する the 法廷,裁判所s to say.'

The workings of the 行為/法令/行動する have now been put on 持つ/拘留する under 法廷,裁判所 of 保護 問題/発行するd directions without ファンファーレ/誇示 last year by Sir James Munby, who 長,率いるs the 法廷,裁判所.

Sir James' direction 支配するd that in 未来 決定/判定勝ち(する)s about the 撤退 of 人工的な 栄養 and hydration 'should be brought to the 法廷,裁判所'.

The 宣言 has now been 公表する/暴露するd to the public in a speech by 上級の 法廷,裁判所 of 保護 裁判官 Mr 司法(官) パン職人.

Mr 司法(官) パン職人 said: '使用/適用s to the 法廷,裁判所 should be obligatory in all 事例/患者s where the 撤退 of 人工的な 栄養 and hydration is 提案するd, at least for the time 存在.'

He 追加するd in the speech, 配達するd in Oxford and published last week: 'The time may come when 使用/適用s to the 法廷,裁判所 are unnecessary save where there is a 論争. But for my part, I do not believe that we have yet got to that point.'

He 追加するd: '医療の science and the 法律 are still 発展させるing. Until such time as we have greater clarity and understanding about the disorders of consciousness, and about the 合法的な and 倫理的な 原則s to be 適用するd, there remains a need for 独立した・無所属 oversight.'

The 裁判官 said that 'at first sight' the living wills 法律 'seems a sound and useful 準備/条項.'

But, Mr 司法(官) パン職人 said, に引き続いて Sir James' direction, 'some 疑問 has been 表明するd as to whether an 前進する 決定/判定勝ち(する) or the 力/強力にする vested in the donee of a 継続している 力/強力にする of 弁護士/代理人/検事 延長するs to 決定/判定勝ち(する)s 関心ing a 提案 to 保留する or 身を引く 人工的な 栄養 and hydration.

'It is to say the least unfortunate that there should be such 不確定 and it is to be hoped that the 適切な時期 will arise soon for the 法廷,裁判所s to 解決する this question,' Mr 司法(官) パン職人 追加するd.

Under a living will, people can instruct doctors to withdraw their medical treatment if they become incapacitated and unable to make decisions for themselves

Under a living will, people can 教える doctors to 身を引く their 医療の 治療 if they become incapacitated and unable to make 決定/判定勝ち(する)s for themselves

No 公式の/役人 人物/姿/数字s have ever been published on numbers of people who have been killed by 撤退 of 栄養 and hydration tubes in 一致 with Mental Capacity 行為/法令/行動する 支配するs on living wills or 継続している 力/強力にする of 弁護士/代理人/検事.

Mr 司法(官) パン職人 said: 'So far as I am aware, there is no instance in this country of a 事例/患者 in which 人工的な 栄養 and hydration has been withheld or 孤立した from a 患者 苦しむing from a disorder of consciousness without 言及/関連 to the 法廷,裁判所.'

However 事例/患者s decided by the 法廷,裁判所s in which the 撤退 of fluid and 栄養 tubes has been 許すd are thought to have numbered in the hundreds since 1993, when a 決定/判定勝ち(する) by the 法律 Lords first made it lawful.

Sir Jonathan パン職人, 61, said in his speech that there are no 設立するd 医療の 支配するs to decide when someone is in a 永久の vegetative 明言する/公表する, and that families often 同意しない with doctors about the 条件 of incapacitated loved ones.

He 追加するd that 患者s who have made 前進する 指示的なs may change their minds, may have been 影響(力)d by others, and may not have thought through their 決定/判定勝ち(する).

However Lord Falconer questioned the 権利 of 裁判官s to overrule 法律制定 made by 議会. Lord Falconer, who was Lord (ドイツなどの)首相/(大学の)学長 between 2003 and 2007, is now a 選挙運動者 for an 補助装置d dying 法律 that would give doctors the 権利 to help terminally ill 患者s to die.

Lord Falconer said that the 影響 of Sir James' direction would be that doctors would never put living wills into 影響 in 一致 with the 条件 of the 行為/法令/行動する, and that NHS lawyers would always advise 医療の staff that the 条件 of the 行為/法令/行動する should be ignored.

He said: 'My 見解(をとる) is the Mental Capacity 行為/法令/行動する was ーするつもりであるd to be 支配する to very strict 保護(する)/緊急輸入制限s, and they are 厳格な人 when questions of life may come into it.

'The 保護(する)/緊急輸入制限s have to be gone through, and it has to be 確かな that the 前進する 指示的な is 訂正する and what the person ーするつもりであるd, but then the 前進する 指示的な takes 影響. If there is a 疑問 over whether an 前進する 指示的な was 正確に drawn up, then that is a 事柄 for a 裁判官. The 行為/法令/行動する is (疑いを)晴らす.'

Critics of the Mental Capacity 行為/法令/行動する 拍手喝采する the 裁判官s for their 活動/戦闘.

Robert Flello, 労働 MP for Stoke-on-Trent South, said: 'I am rarely in sympathy when 裁判官s start re-解釈する/通訳するing the 法律, but in this 事例/患者, for the 保護 of public, it i s 権利 and proper that the 法廷,裁判所 of 保護 should consider every 事例/患者.

'There is a history of problems with the Mental Capacity 行為/法令/行動する. One of the problems was that Charlie Falconer and his 支持者s used it as a 乗り物 to bring in 安楽死 through the 支援する door.'?
