The 59-year-old, from Swindon, Wiltshire, filled up his Mercedes （短距離で）速く走る人 先頭 with 61 litres of ディーゼル from his 地元の Tesco Extra 蓄える／店 in November 2003.

It had already made an 初期の 支払い（額） of £1,060 to him two years earlier, which he had only ever 受託するd as a "part 支払い（額）".

But nearly three months after the 判決，裁定, Tesco has still failed to 支払う／賃金 a penny of the 損害賠償金 to Mr 社債.

His lawyer （人命などを）奪う，主張するd he could have begun winding up 手続きs against Tesco, or 試みる／企てるd to have their 資産s frozen, but 選ぶd to have the cas e transferred to the High 法廷，裁判所.

An 施行 officer 結局 掴むd ワイン, spirits and beer - 価値（がある） £60,000 - from the St Oswalds Road 蓄える／店 in Gloucester on March 1.

The goods have been 効果的に "impounded" in the shop and the booze could be sold off "in a 事柄 of days" if the money still has not been paid.

"This is a modern-day story of David and Goliath," Mr 社債's solicitor Barry Bennington, from 法律 会社／堅い Withy King, said.

"It then 取り消すd on its 約束s and ignored the 条件 課すd by the 法廷，裁判所. Tesco's arrogant 態度 に向かって both its 顧客 and the 法律, has been 驚くべき／特命の／臨時の."

Mr 社債 （刑事）被告 the 小売 巨大（な） of believing it was "bigger than the 法廷，裁判所s" as he continues to wait for his cash.

"The 底（に届く） line is if they put their money where their mouth is and said 'we're not responsible' they could take me to wherever they 手配中の，お尋ね者.

"But they didn't. They put their 手渡すs up and said they were in the wrong. They will have to 支払う／賃金 me 利益／興味. Maybe they think they're bigger than the 法廷，裁判所s and can ignore them. But they can't."

Tesco today apologised to 顧客s who had been 影響する／感情d by last week's 汚染するd 燃料 危機 and 約束d to 支払う／賃金 their 修理 法案s.

But Mr Bennington said it was "ironic" the supermarket was making the 誓約（する） after failing to 支払う／賃金 his （弁護士の）依頼人.

"This 事例／患者 明確に shows that the 問題／発行する of 汚染するd 燃料 is not just a 最近の one, and a 重要な number of other drivers may also have been 影響する／感情d.

"There may be other 運転者s out there who have bought 汚染するd 燃料 and si mply 受託するd an 陳謝 or reimbursement for the cost of their 燃料, without realising they are する権利を与えるd to 補償（金） for any 損失 原因（となる）d to their 乗り物s."

A Tesco 広報担当者 said they were looking into the story.
