Life-支えるing 治療 for brain-損失d woman 'no longer in her best 利益/興味'

A 裁判官 has given his 推論する/理由s for 判決,裁定 that life-支えるing 医療の 治療 could be 孤立した from a woman who 苦しむd 深遠な brain 損失 while on holiday in Turkey four years ago.

Although the "充てるd" wife and mother at the centre of the 事例/患者 had shown 調印するs of 回復 after the 事故 - reaching a 行う/開催する/段階 where she could read very simple words and 宣告,判決s and recognised her friends and family - her 条件 later 悪化するd, leaving her in a 永久の vegetative 明言する/公表する (PVS).

Sir 示す Potter, 大統領 of the High 法廷,裁判所's Family 分割, made his 推論する/理由s public today for earlier 認めるing 宣言s to the 無名の hospital caring for the mother-of-two - sought from the 法廷,裁判所 with the 協定 of her family - that it was no longer in her best 利益/興味s to be given life-支えるing 治療 "and that such 対策 might 合法の be discontinued".

He 支配するd on January 17 that に引き続いて discontinuation it was in the best 利益/興味s of the woman, who can only be referred to as SW for 合法的な 推論する/理由s, "to be given such 治療 and nursing and care as might be appropriate to 確実にする that she 保持するd the greatest dignity until such time as her life comes to an end".

Sir 示す said that SW, a "lively and intelligent" mother of two adult sons, was cycling by the sea while on holiday in Turkey on January 11, 2003, when she fell in.

He said: "She was 救助(する)d in an unconscious 明言する/公表する, having 苦しむd a cardio-respiratory 逮捕(する) in 協会 with 溺死するing. She was resuscitated."

However, に引き続いて resuscitation, a CT ざっと目を通す was carried out and SW, who had been "a very 去っていく/社交的な and active person" and a keen member of the sailing fraternity, was 設立する to have 苦しむd "深遠な anoxic brain 損失".

She was flown 支援する to Britain where that 条件 was 確認するd.

The 裁判官 追加するd: "にもかかわらず that brain 損失, after a while SW showed 調印するs of 回復 and made 漸進的な but 安定した 改良 until, by 中央の-2003, she was able to communicate by speaking a few words.

"She appeared to understand simple 命令(する)s and could make 限られた/立憲的な choices.

"She was able to 圧力(をかける) a switch with her chin using a 長,率いる rotation ーするために 活動させる/戦時編成する a stereo.

"She reached a 行う/開催する/段階 where she could identify colours, tell the time, read very simple words and 宣告,判決s, and even repeat some words in French to her husband. She recognised friends and family."

The 裁判官 said: "Sadly, she 苦しむd from 厳しい spasticity in her 四肢s, which より悪くするd, although her cognition 改善するd."

He said: "広大な/多数の/重要な care and devotion was shown and the care by her husband, PW, in 補助装置ing her 回復 and enjoyment of life was noteworthy and, besides recognising and 答える/応じるing to family members, she (機の)カム to 高く評価する/(相場などが)上がる going out in her 車椅子 with him."

But her level of 認識/意識性 and responsiveness 意味ありげに 拒絶する/低下するd from October 2004 "for 推論する/理由s which are by no means (疑いを)晴らす 削減(する)," said Sir 示す.

He said there was an "unusual 臨床の picture in this 事例/患者 in relation to a 診断する of PVS, すなわち SW's 改良 and 出現 from the vegetative 明言する/公表する and thereafter her 悪化/低下 in late 2004".

Sir 示す said SW was last 記録,記録的な/記録するd as having made any form of 言葉の 返答 in September 2005.

"Since that time she has remained 完全に reliant upon 医療の staff for all her needs, 要求するing 24-hour nursing attention."

It was the 全員一致の opinion of the 医療の 専門家s who 診察するd SW that she "has long since moved into a 永久の vegetative 明言する/公表する".

In May last year her husband wrote to his wife's 顧問 知らせるing him that all members of her 即座の family were in 協定 that an 使用/適用 should be made to the 法廷,裁判所 for the hospital to be able to 身を引く 人工的な 栄養 and hydration as they felt it was what SW herself would have 手配中の,お尋ね者.

Sir 示す said he made his 判決,裁定 on January 17 on the basis of the 証拠 before him and having heard oral 証拠 from three 著名な medi cal 専門家s.

The 裁判官 said SW and her husband had retired 早期に so they could both do more sailing together.

"In those circumstances the long-称する,呼ぶ/期間/用語 影響s of her 事故 were more than usually 悲劇の in a 状況/情勢 where the devotion of her family, 連合させるd with 集中的な 医療の care, 証明するd unable 最終的に to 緩和する her sad 明言する/公表する.

"存在 確信して that SW was not aware of herself, her 条件, or her 環境, and based on previous conversations with SW at times when she was 井戸/弁護士席 and active, the family believe that she would not herself wish to remain alive in her 現在の 条件.

"I have no 疑問 they are 訂正する. その上の I would like to 支払う/賃金 particular 尊敬の印 to PW's loving and conscientious devotion to the care of SW ever since she was first 認める to hospital に引き続いて her 事故."
