政府 企て，努力，提案 to 国外追放する Lawrence 殺し屋 is 辞退するd AGAIN

Learco Chindamo

A 上級の High 法廷，裁判所 裁判官 has 辞退するd a 政府 request to 再考する the 決定／判定勝ち（する） that Philip Lawrence's 殺し屋 cannot be 国外追放するd.



A 法廷 decided in August that Learco Chindamo, 26, cannot be 国外追放するd to his native Italy because 除去するing him from the country would 違反 his human 権利s and break EU 法律s.

移民／移住 大臣 Liam Byrne 教えるd 公式の／役人s to 適用する to a 上級の 裁判官 for a last-溝へはまらせる／不時着する review.

But Mr 司法（官） Collins has upheld the 亡命 and 移民／移住 法廷's 決定／判定勝ち（する） that Chindamo, 刑務所，拘置所d in 1996, cannot be 国外追放するd on 解放（する）.

辞退するing to order a reconsideration, the 裁判官 said: "There is no error of 法律 in the careful 決意 of the 法廷."

The 判決，裁定 will come as a blow to Mr Byrne, who says the 政府 wants foreign 国家のs who commit serious 罪，犯罪s to be "automatically 国外追放するd".

It also follows news that serial sex 違反者／犯罪者 Mohammed Kendeh is to be 許すd to stay in Britain because 国外追放するing him to his native Sierre Leone would 違反 his human 権利 to a family life.

In the Chindamo 事例／患者, the 裁判官 強調d that his 決定／判定勝ち（する） was おもに based on EU 規則s and the fact that it would be "disproportionate" to 除去する the 27-year-old, as an EU 国民, under those 規則s.

Although born in Italy, Chindamo has lived in the UK since the age of six.



Chindamo was 15 when he stabbed the headmaster outside St George's Roman カトリック教徒 School in Maida Vale, west London, in December 1995.

He was 刑務所，拘置所d for life and told he would have to serve at least 12 years.

Chindamo has 適用するd for 仮釈放（する） and may be 解放（する）d from 刑務所，拘置所 as 早期に as January.

It was 報告（する）／憶測d that 大臣s told フランs Lawrence, the teacher's 未亡人, that they ーするつもりであるd to 捜し出す Chindamo's 国外追放 to Italy when he becomes 適格の for 仮釈放（する） in 2008.

Today the 裁判官 said: "If 保証／確信s were given to the 犠牲者's 未亡人 or to the public that the 控訴人，上告人 would be 除去するd, they should not have been and cannot now 正当化する 除去."
