Jihadi bride Shamima Begum will not be 許すd to return to the UK to challenge 存在 stripped of her 市民権 until the 最高裁判所 has made a 判決,裁定 on a 決定/判定勝ち(する) to let her 支援する into the country.
Lawyers for the 政府 were 認めるd leave to 控訴,上告 to the highest 法廷,裁判所 in the land and challenge an earlier 判決,裁定 that 許すd Begum to appear in person and argue against 存在 stripped of her 市民権.
Three 控訴,上告 法廷,裁判所 裁判官s agreed there should be a stay on any movement until after the 最高裁判所 had made their 判決,裁定 which is 推定する/予想するd later this year.
Lady 司法(官) King, sitting remotely with Lord 司法(官) Singh and Lord 司法(官) Flaux, 支配するd that the 控訴,上告 against her return should be heard by the 最高裁判所.
The three 裁判官s had earlier this month 支配するd that Begun, who fled to Syria when she was 15 years old 許可 to return from the 難民 (軍の)野営地,陣営 where she is held to appear in person before an 移民/移住 控訴,上告s board.
Lawyers for the 政府 had 主張するd that she 提起する/ポーズをとるd a 危険 to 国家の 安全 and should not be 許すd 支援する into the UK.
In the remote 審理,公聴会 today Sir James Eadie for the 政府 said while there was some sympathy for Begun 予定 to her age she had chosen to ‘提携させる herself with テロリストs’.
‘She did leave with 意図 and did 提携させる herself with violent 極端論者s in Syria with Isis,’ he said.
控訴,上告: Begum challenged the 決定/判定勝ち(する) made by then Home 長官 Sajid Javid 説 she now 恐れるd for her life. Her third child?Jarrah, pictured in her 武器, died at three weeks old
‘There is a big 問題/発行する at 火刑/賭ける here. What 主要な/長/主犯s should 治める/統治する a 事例/患者 where a person can get a fair 審理,公聴会 because they have placed themselves, not as a result of any 国務長官 活動/戦闘 but where that is the result of going abroad and 提携させるing with テロリストs groups.
‘It is the 査定/評価 of the 政府 that they 提起する/ポーズをとる a 危険 to 国家の 安全 n the UK were they to return.
'There may be some sympathy of her age, but she did leave with 意図 and did 提携させる with violent 極端論者s in Syria with ISIS.'
Begum was one of three east London schoolgirls who travelled to Syria to join the Islamic 明言する/公表する group in February 2015.
She was 15 years old and about to sit her GCSE exams when having (人命などを)奪う,主張するd to have been ‘groomed’ by watching ビデオs of people 存在 遂行する/発効させるd she decided to 逃げる to Syria and join terror organistion.
She lived under IS 支配する for more than three years before she was 設立する, nine months 妊娠している, in a Syrian 難民 (軍の)野営地,陣営 in February last year.
The then-home 長官 Sajid Javid, 取り消すd her British 市民権 on 国家の 安全 grounds after she was discovered nine months 妊娠している in a 難民 (軍の)野営地,陣営.
A Special 移民/移住 控訴,上告s (売買)手数料,委託(する)/委員会/権限 upheld the Home Office’s 決定/判定勝ち(する) and 支配するd that she should not be 許すd to return and said she could (人命などを)奪う,主張する Bangladeshi 市民権 through her father.
Begum, now 20, took 合法的な 活動/戦闘 against the Home Office, (人命などを)奪う,主張するing the 決定/判定勝ち(する) was unlawful because it (判決などを)下すd her stateless and exposed her to a real 危険 of death or 残忍な and degrading 治療. Her lawyers (人命などを)奪う,主張するd she 直面するd 死刑執行 if returned to Bangladesh or Iraq.
Lord 司法(官) Flaux, Lady 司法(官) King and Lord 司法(官) Singh 支配するd that Begum should be 許すd to return to the UK to 追求する her 控訴,上告 ? 誘発するing 乱暴/暴力を加える and 関心 that other Jihadis who left Britain would also be able to return.
The 政府 said it was "激しく disappointed" by the 判決,裁定, while Mr Javid said he was "深く,強烈に 関心d" by the judgment.
Human 権利s groups have 支援するd Begun’s return to appear before the Special 移民/移住 控訴,上告s Commisiom/
Katie Lines from Liberty said: "The 権利 to a fair 裁判,公判 is not something the 政府 can take away on a whim."
Earlier in the 審理,公聴会 this morning the three 控訴,上告 法廷,裁判所 裁判官s said the 司法長官 would be asked to look at a ' 潜在的に very serious contempt' after their earlier 判決,裁定 on Begun was 漏れるd to a newspaper.?
Sir James Eadie QC, for the Home Office, earlier said there was 'a big 問題/発行する at 火刑/賭ける', すなわち 'what 原則s and approach should 治める/統治する a 事例/患者 in which someone at 現在の cannot have a fair and 効果的な 審理,公聴会 in a deprivation 控訴,上告, but they cannot do so because they have placed themselves, not as a result of any of the 国務長官's 活動/戦闘s, (but) where that is the result of going abroad and 提携させるing with テロリスト groups'.
Jihadi bride Shamima Begum has been pictured today wearing ジーンズs, a shirt and a blue hat as she walked through a Syrian 難民 (軍の)野営地,陣営 earlier this month
Sir James said it was 'an 問題/発行する of real 圧力(をかける)ing public importance' which was 'perhaps the central democratic 問題/発行する of our times'.
He 追加するd: 'This cannot be assumed to be unique or even, given the number of people who have 提携させるd in this way, to be a 高度に unusual 事例/患者.'
Sir James said Ms Begum was 'in 正確に the 部類 that 原因(となる)s real 関心'.
He submitted that, while there may be 'some 可能性のある for sympathy in light of the age she was when she left the 裁判権 ... she did leave the 裁判権 with the 意向 of, and then did 提携させる with violent 極端論者s in Syria'.
The 法廷,裁判所 also heard that the 明らかな 漏れるing of the 法廷,裁判所 of 控訴,上告's 草案 judgment 'or the 必須の contents of that judgment' to The Sun ahead of its formal 出版(物) would be referred to the 司法長官.
At the 手始め of Friday's 審理,公聴会, Lady 司法(官) King said: 'There was a 違反 of the 出入港禁止 which 保存するd the confidentiality of the judgment until 手渡す 負かす/撃墜する, the judgment having been 循環させるd to the parties on July 9.
'Either a copy of that judgment, or the 必須の contents of that judgment, were 公表する/暴露するd or passed on to The Sun 国家の newspaper in 前進する of the judgment 存在 手渡すd 負かす/撃墜する on July 16.'
The 裁判官 追加するd that 'the article was 除去するd during the course of the night' before the 法廷,裁判所 of 控訴,上告 gave its 判決,裁定.
Lady 司法(官) King also said that the article 'rightly or wrongly referred to '上級の 政府 sources' as having been the source of the (警察などへの)密告,告訴(状)'.
She said: 'We ーするつもりである to 報告(する)/憶測 that 事柄 to the 司法長官.'?
Jihadi bride Shamima Begum, 20, is desperate to return to Britain five years after she 任意に left to join ISIS in Syria - her British 市民権 was 取り消すd when she was 設立する in a 難民 (軍の)野営地,陣営 after the caliphate fell last year
In February this year, the Special 移民/移住 控訴,上告s (売買)手数料,委託(する)/委員会/権限 (SIAC) - a specialist 法廷 which hears challenges to 決定/判定勝ち(する)s to 除去する someone's British 市民権 on 国家の 安全 grounds - 設立する Ms Begum 'cannot play any meaningful part in her 控訴,上告 and that, to that extent, the 控訴,上告 will not be fair and 効果的な'.
But SIAC 支配するd that 'it does not follow that her 控訴,上告 後継するs' and Ms Begum's challenge to the Home Office's 決定/判定勝ち(する) to 辞退する to 許す her to enter the UK to 効果的に 追求する her 控訴,上告 was also 拒絶するd.
However, earlier this month, the 法廷,裁判所 of 控訴,上告 支配するd that 'the only way in which she can have a fair and 効果的な 控訴,上告 is to be permitted to come into the 部隊d Kingdom to 追求する her 控訴,上告'.
Lord 司法(官) Flaux - sitting with Lady 司法(官) King and Lord 司法(官) Singh - said: 'Fairness and 司法(官) must, on the facts of this 事例/患者, outweigh the 国家の 安全 関心s, so that the leave to enter 控訴,上告s should be 許すd.'
The 裁判官 設立する that 'the 国家の 安全 関心s about her could be 演説(する)/住所d and managed if she returns to the 部隊d Kingdom'.
Lord 司法(官) Flaux also said: 'With 予定 尊敬(する)・点 to SIAC, it is 考えられない that, having 結論するd that Ms Begum could not take any meaningful part in her 控訴,上告 so that it could not be fair and 効果的な, she should have to continue with her 控訴,上告 nonetheless.'
He 追加するd: 'It is difficult to conceive of any 事例/患者 where a 法廷,裁判所 or 法廷 has said we cannot 持つ/拘留する a fair 裁判,公判, but we are going to go on anyway.'??
Earlier this month MPs and 犠牲者s of Islamic 明言する/公表する 残虐(行為)s 反応するd furiously to the 決定/判定勝ち(する).
Tory MP Andrew Bridgen said it 危険d a flood of jihad is returning. He told MailOnline: 'It opens the door for all her fellow jihadi brides to return to Britain ? and 潜在的に their テロリスト partners too.?
'Most Brits will rightly think that when you 断言する 忠誠 to another country that 宣言するs war on Britain, that you have given up all the 権利s and 保護s and 特権s of your British 市民権. After today's 判決,裁定 it appears you have not'.??
