An office 経営者/支配人 has won an £11,000 payout after her 'petulant' building 会社/堅い boss waited until she gave birth and then 解雇(する)d her.?

'Diligent and hard-working' Izabela Szachta 繰り返して checked in to see how work was going while on maternity leave, only to discover her 職業 was at 危険 while she was ひどく 妊娠している.

Her boss Ben MacMillan, who outsourced her work, later told her: 'What would you do? Tell a 妊娠している woman she is losing her 職業 or tell a woman on maternity leave?'

Mr MacMillan, 44, who runs West End building 会社/堅い Argyll London, had not told Ms Szachta about his 計画(する)s to use the outsourcing company 永久的に before she went on leave.

Mr MacMillan, whose company builds homes and workspaces, assumed she'd be '感謝する' for the 申し込む/申し出 and 'petulantly' started 非難するing her for work 問題/発行するs when she 辞退するd to 受託する it.

Now Ms Szachta has won £11,000 after 告訴するing Argyll London for pregnancy and sex 差別.

The 雇用 法廷 in East London, heard that Mr MacMillan 設立する outsourcing 会社/堅い Insight's 申し込む/申し出 '高度に persuasive' and was in 会談 with them in November 2018, three months before Ms Szachta went on maternity leave.

However, it heard Mr MacMillan 'did not discuss' the outsourcing company's 永久の 役割 with Ms Szachta before she went on maternity leave, which left her in the dark about her 未来 redundancy.

Ms Szachta - who 'had a strong work ethic' - checked in while she was off to see how the 商売/仕事 was going but Mr MacMillan, who by this point decided she was redundant, ignored her message.

雇用 裁判官 Tim Russell said criticised Mr MacMillan for failing to Ms Szachta her 職業 was at 危険 sooner.

裁判官 Russell also criticised his '不適切な' comments. The 裁判官 said: '[There was an] 仮定/引き受けること that Ms Szachta would 受託する the part-time 職業 申し込む/申し出d because she had just had a baby.

'In other words, that she would not want to return to work 十分な-time d ue to her childcare かかわり合いs and status as a mother.

'[The comment] was an 不適切な stereotypical 仮定/引き受けること based upon sex, すなわち that a woman with a baby would want to work part-time.'

裁判官 Russell 追加するd: 'As we have 設立する, Mr MacMillan began criticising Ms Szachta's 業績/成果 only after she 反対するd to the 申し込む/申し出 of a part-time 職業 and challenged the 決定/判定勝ち(する) to make her redundant.

'The fact that at this 審理,公聴会 Mr MacMillan again 受託するd that the problems with the bookkeeping 機能(する)/行事 were not the fault of Ms Szachta, so much as the systemic 欠陥s, leads the 法廷 to 結論する that the 批評 of her 業績/成果 was 不当な.

'[The 批評] was 訴える手段/行楽地d to as a means t o 正当化する the 決定/判定勝ち(する) to move to [outsource 会社/堅い] Insight.

'This, we consider, was borne of a degree of irritation and even petulance on the part of Mr MacMillan when Ms Szachta 簡単に did not 受託する the 申し込む/申し出 which he thought she would be 感謝する for as she had a new child.'

It was heard Ms Szachta was not 十分に financially qualified to 扱う bookkeeping but that this was a 欠陥 in Mr MacMillan's 商売/仕事 model.

During the handover period to the outsourcing 会社/堅い, Ms Szachta 受託するd finding £83,000 in 行方不明の invoices, which Mr MacMillan later criticised her for.
