My new car is the wrong colour. Can I get 補償(金)? DEAN DUNHAM replies

My new car has been 配達するd and it’s the wrong colour. The car 売買業者 has agreed to take it 支援する but says I won’t get a new one for months - yet won’t 申し込む/申し出 a 儀礼 car.?

Can I (人命などを)奪う,主張する 補償(金) from the 売買業者?

消費者 権利s lawyer Dean Dunham replies:?When you buy goods - 含むing cars - the 消費者 権利s 行為/法令/行動する 2015 明言する/公表するs they must be ‘as 述べるd’ so in your 事例/患者 the dealership had a 合法的な 義務 to take the car 支援する.?

However, as you say, this still leaves you in a position of loss of a car to 運動 for a number of months. My 見解(をとる) is you can (人命などを)奪う,主張する 補償(金) or 需要・要求する a 儀礼 car from the dealership, under one of two 原則s.

Firstly, the 消費者 権利s 行為/法令/行動する 供給するs that where goods are 存在 取って代わるd, the 仲買人 must 供給する the 交替/補充 ‘within a reasonable time’ and ‘without 重要な inconvenience to the 消費者’.?

Your dealership is probably not 違反ing the first element as it takes time to source new cars but 明確に you are 存在 inconvenienced and this gives you grounds to ask for 補償(金) or a 儀礼 car.

If all else fails, you could take the matter to the small claims court, if you feel it’s worth it financially, says Dean Dunham

The second approach you could take is to 明言する/公表する that under English 法律 the 治療(薬) for 違反 of 契約 (the 違反 存在 the car arrived in the wrong colour) is to put the innocent party (you) 支援する into the position you would have been in had the 違反 not occurred.

Here, this would mean you have a car to 運動, either the new one or your old car before you sold or part 交流d it, if this is what you did.?

適用するing this 原則 will mean the dealership will either have to 供給する you with a 儀礼 car or 支払う/賃金 you 補償(金) so you are not out of pocket whilst waiting for the 交替/補充 car to arrive.?

If the dealership 拒絶するs your (人命などを)奪う,主張する, you could take the 事柄 to the small (人命などを)奪う,主張するs 法廷,裁判所, if you feel it’s 価値(がある) it financially.

A tree on the pavement outside my house has leant ominously に向かって my roof since the 嵐/襲撃する of 1987. The tree has been left by the 会議 to grow without any 維持/整備 for years. I 恐れる it could be a danger to life or to my 所有物/資産/財産. What are my 権利s?

Dean Dunham replies: Each 会議 has an 義務 to 確実にする that trees within its 所有権 are 安全な for both 主要道路 使用者s and 隣接する land. This 最終的に means 会議s must have 維持/整備 政策s and 計画(する)s in place, setting out a system to 定期的に 検査/視察する trees. I would therefore advise you to 令状 again to the 会議 and ask two things. Firstly for a copy of its 関連した 維持/整備 政策 in relation to the tree outside your house. Secondly ask for it to 再考する its position in relation to this tree, making sure you 明確に 始める,決める out why you feel it needs 緊急の attention with supporting 証拠, such as photographs, if possible.

You should also tell the 会議 that you will take the 事柄 to the 地元の 政府 and Social Care Ombudsman if you do not receive a 満足な 結果.

Make sure you send the ombudsman copies of all communications you’ve had with the 会議 and any 証拠 you have to support your 関心s about the safety of the tree.

いつかs when I’m asked about 危険な trees it transpires that the tree is not owned by the 会議, but is in fact owned by a 隣人.?

If this turns out to be the 事例/患者 here, 令状 to your 隣人 - and it’s important to 令状 rather than ask 口頭で - and 株 your 関心s. The general position is that landowners have a 義務 of care and are therefore 責任がある the safety of their trees.

If your 隣人 ignores you, the next step is to 接触する the 地元の 会議 and explain the 状況/情勢, as it has discretionary 力/強力にするs under section 23 of the 地元の 政府 (Miscellaneous 準備/条項s) 行為/法令/行動する, 1976 to を取り引きする danger to persons or 所有物/資産/財産 from a tree on 私的な land.
