A 禁止(する) on 祈り rituals at a 最高の,を越す London school was supported by 上級の イスラム教徒s,?its headteacher has said.

Michaela Community School in Brent, north London, 直面するd 合法的な 活動/戦闘 from a pupil, who (人命などを)奪う,主張するd its 政策 was 差別的な and unlawfully 違反d her 権利 to 宗教的な freedom.?

One of the five 中心存在s of Islam is for イスラム教徒s to pray five times a day. However, school 長,率いる Katherine Birbalsingh?told the 法廷,裁判所 that observant イスラム教徒 pupils who 行方不明になるd the Dhuhr 祈り could (不足などを)補う for it at a nearby 市民の centre after school.?

In a judgment on Tuesday, a 裁判官 結論するd the 禁止(する) did not 干渉する with the student's 権利s and was 'proportionate' まっただ中に the school's 目的(とする) to 促進する an ethos of inclusivity and social cohesion.

Mrs Birbalsingh, also the high-達成するing school's 創立者 dubbed Britain's strictest headteacher, said she had spoken to the imam at the London Central イスラム教寺院 and Islamic Cultural Centre after introducing the 禁止(する).??

In 法廷,裁判所 papers, she said the imam 'agreed with this 見解(をとる) and 申し込む/申し出d to speak to any イスラム教徒 parents who had 疑問s on this point'.

Speaking after the 判決,裁定 on Tuesday, she went on: 'A school should be 解放する/自由な to do what is 権利 for the pupils it serves. The 法廷,裁判所's 決定/判定勝ち(する) is therefore a victory for all schools.

'Schools should not be 軍隊d by one child and her mother to change its approach 簡単に because they have decided they don't like something at the school.'

She said the school of some 700 pupils, about half of whom are イスラム教徒, embraces '伝統的な values' where 'children are happy and are friends with each other across racial and 宗教的な divides'.

Ms Birbalsingh said people are 知らせるd about its strict 支配するs before pupils join, 追加するing: 'If parents do not like what Michaela is, they do not need to send their children to us.'

The student, who cannot be 指名するd, said after the 判決,裁定 that her school was 'very 井戸/弁護士席 run', had good teachers and that 存在 伴う/関わるd in the 事例/患者 'has not been 平易な for me'.

'Even though I lost, I still feel that I did the 権利 thing in 捜し出すing to challenge the 禁止(する). I tried my best and was true to myself and my 宗教,' she said.

Her mother, who supported the challenge, said: 'The 事例/患者 was rooted in the understanding that 祈り isn't just a 望ましい 行為/法令/行動する for us - it's an 必須の element that 形態/調整s our lives as イスラム教徒s.?

Some イスラム教徒 leaders told of their 失望 in the 判決,裁定, with Dr Abdul-Azim Ahmed, 長官 general of the イスラム教徒 会議 of むちの跡s, 説 the 法廷,裁判所 'hasn't defended a very 井戸/弁護士席-設立するd British 原則 of freedom of 宗教'.

At a 審理,公聴会 in January, the 法廷,裁判所 was told that Ms Birbalsingh, a former 政府 social mobility tsar, introduced the 政策 in March last year, with it 存在 支援するd by the 治める/統治するing 団体/死体 in May.

In March 2023, up to 30 students began praying in the school's yard, using blazers to ひさまづく on.

Lawyers for the school said students seen praying outside 与える/捧げるd to a '一致した (選挙などの)運動をする' on social マスコミ over the school's approach to 宗教, with there also 存在 a since-除去するd online 嘆願(書) attracting thousands of 署名s.

The 法廷,裁判所 heard the school was 的d with death 脅しs, 乱用, '誤った' 主張s of Islamophobia and a '爆弾 hoax'.

The student's lawyers argued the 禁止(する) on 祈り rituals on the 前提s 'uniquely' 影響する/感情d her 約束 予定 to its ritualised nature.

The pupil 申し立てられた/疑わしい the school's 姿勢 on 祈り - one of the five 中心存在s of Islam - was 'the 肉親,親類d of 差別 which makes 宗教的な 少数,小数派s feel 疎遠にするd from society'.

Her 合法的な team said she was making a 'modest' request to be 許すd to pray for around five minutes at lunch time, on dates when 約束 支配するs 要求するd it, but not during lessons.

The school argued its 政策 was 正当化するd as it 危険d '土台を崩すing 傾向 and social cohesion' between pupils, would again expose it to 'an 容認できない 危険 of 脅しs' and that it 避けるd 'logistical disruption'.?

In her 証言,証人/目撃する 声明, the girl said she had been at the school for nearly three academic years and all her friends were there.?

'She does not want to go to a new school and start again. She does not want to go to an Islamic school or a different 世俗的な school.?

'She values the teaching at the school which she 述べるs as 'excellent' and she thinks she is likely to do 井戸/弁護士席 if she stays,' the 声明 said.

'She does not think that she would be able to 接近 such a high 基準 of education どこかよそで in her area and a move would be very 破壊的な to her education.

'She wishes to do 井戸/弁護士席 enough in her GCSEs to go to the school's sixth form. Moving would be very difficult for her as other schools are likely to have different exam boards or 始める,決める texts.?

'She 行方不明になるd a 確かな 量 of school in year 9 借りがあるing in part to the [two] 除外s. Having to move would 'really 始める,決める me 支援する'.'

Mr 司法(官) Linden 結論するd there was 'a 合理的な/理性的な 関係 between the 目的(とする) of 促進するing the team ethos of the school, inclusivity, social cohesion etc and the 祈り ritual 政策'.

He said: 'The disadvantage to イスラム教徒 pupils at the school 原因(となる)d by the 祈り ritual 政策 is in my 見解(をとる) outweighed by the 目的(とする)s which it 捜し出すs to 促進する in the 利益/興味s of the school community as a whole, 含むing イスラム教徒 pupils.'

He said the student had 'at the very least impliedly 受託するd' that she would be '支配する to 制限s on her ability to manifest her 宗教' when joining the 世俗的な school.

The 裁判官 said the pupil could also 成し遂げる 'Qada' 祈りs - permitted by Islam to '(不足などを)補う' for 行方不明の 祈りs earlier in the day - 'to mitigate the 失敗 to pray within the allotted window'.

He 受託するd the 祈り 政策 原因(となる)d the pupil a 'detriment' but 結論するd it was 'a proportionate means of 達成するing a 合法的 目的(とする)', 追加するing that the school was justi fied in deciding that there were practical difficulties in 許すing indoor イスラム教徒 祈り during the school day.

Mr 司法(官) Linden said of the student: 'I do not 疑問 that she has strong feelings, but she says that they are based on the whole of the events which have led to this (人命などを)奪う,主張する ... and on her 見解(をとる)s that she has been 扱う/治療するd 異なって because she is a イスラム教徒, that she is the 犠牲者 of 差別, and that she has 効果的に been told that she does not '適切に belong here', 非,不,無 of which is in fact the 事例/患者.'

証拠 showed that since the 祈り rituals 禁止(する) was introduced 'good relations within the school community have been 回復するd', the 裁判官 said.

He upheld the student's challenge to a 決定/判定勝ち(する) to 一時的に 除外する her from the school as a 違反 of its 義務 'to 行為/法令/行動する 公正に/かなり'.
