Friday's 判決,裁定, which 始める,決めるs in train windfall 支払い(額)s for almost one million 適格の policyholders, followed three days of 証拠 submitted by さまざまな parties to a High 法廷,裁判所 裁判官 in London.

The 審理,公聴会 itself was the final 行う/開催する/段階 of a 過程 spanning more than three years.

At the heart of the 口論する人 was a multi-billion 続けざまに猛撃する 'spare' cash pile, which it was agreed in 法廷,裁判所 will be 分裂(する) between Aviva and the policyholders.

Aviva あられ/賞賛するd the judgment as ' 代表するing good value for 99 per cent of policyholders'.

Clare Spottiswoode, whose 職業 has been to fight for the best 取引,協定 for policyholders, was いっそう少なく pleased, 説 only that the 結果 was 'good under 現在の 支配するs'.

But the 財政上の Services 当局's 規則s, she said, favoured the company and not the 顧客s.

Many policyholders are far from pleased. 財政上の Mail is aware of at least two 差し迫った 法廷,裁判所 事例/患者s where aggrieved policyholders will continue to fight and there may be wider 関わりあい/含蓄s for hundreds of thousands of other policyholders.

Policyholder John Pilkington has 始めるd 訴訟/進行s at Worcester 郡 法廷,裁判所.

He is (人命などを)奪う,主張するing that the special 特別手当s paid as an earlier part of the 過程 to carve up the cash pile were 不公平に 減ずるd for some savers.

Under an earlier part of the reattribution 協定, Aviva agreed to 支払う/賃金 £2.1bn to policyholders in the form of three tranches of 特別手当s to be 追加するd to 政策s at the beginning of 2008, 2009 and 2010.

The 特別手当s were calculated as 百分率s of the values of 政策s and were 述べるd as a 'special 配当'. But thousands of with-利益(をあげる)s 社債 投資家s had their 配当s 減ずるd 予定 to the 課税 of what was de scribed as a 'market value 削減'.

This 削減(する) some payouts by だいたい 20 per cent and it is this that John, a retired dentist from Gloucestershire, is contesting.

Aviva has asked for the 事例/患者 to be switched from Worcester to the High 法廷,裁判所 in London.

Peter Ryan, another policyholder, 計画(する)s to 開始する,打ち上げる three separate 郡 法廷,裁判所 (人命などを)奪う,主張するs. A former stockbroker and a meticulous 研究員 of 法人組織の/企業の history,

Peter, from Doddinghurst, Essex, is 告発する/非難するing Aviva of failing to pass on 投資 returns to policyholders. He (人命などを)奪う,主張するs that in the life of his 政策, taken out in 1993,

Aviva held 支援する more than half of the returns that his 投資s 生成するd.

The main players in windfall 戦う/戦い

適格の Aviva policyholders have been 投票(する)ing 圧倒的に in support of the 取引,協定 and will be pleased to get their cheques, but many 恐れる they have been tricked out of something.

Aviva says it has sought to be 'scrupulously fair throughout', but policyholder 行動主義者s such as 70-year-old Ray Hague (人命などを)奪う,主張する it has 行為/法令/行動するd to the detriment of policyholders.

Ray, from Waddon, Surrey, has held a 政策 for 23 years. He is part of an active group of policyholders that 含むs John Pilkington and which …に反対するd the reattribution.

The 職業 of Spottiswoode, the policyholder 支持する, was to fight for the best possible 取引,協定 for policyholders and - within her remit - she is believed to have 後継するd.

She raised wider questions about the unfairness of with-利益(をあげる)s and has been a scathing critic of the regulator, the 財政上の Services 当局.

She said the FSA had got its sums wrong when trying to 査定する/(税金などを)課す whether the 取引,協定 was fair. But Spottiswoode 直面するd 批評 herself for 延期するing th e 過程 and for 洞穴ing in to Aviva's 決定/判定勝ち(する) to 減ずる its windfalls after its July 2008 申し込む/申し出.

The 職業 of actuary Nick Dumbreck, the '独立した・無所属 専門家', was to 報告(する)/憶測 on how the 取引,協定 would 影響する/感情 the 現在進行中の 操作/手術 of 政策s and whether it would have a 消極的な 衝撃. He 効果的に supported the 取引,協定, but his independence and rigour was challenged in 法廷,裁判所 when it was 申し立てられた/疑わしい that his 会社/堅い had been 雇うd by Aviva in the 最近の past.

The 財政上の Services 当局 現れるd in the worst light, 述べるd as Aviva's 'simpering lackey' and 'poodle'.

Peter Ryan said after the 判決,裁定: 'The FSA isn't about 保護するing the little man, it's about serving the 利益/興味s of big companies.'

Dominic Lindley, 財政上の 専門家 at 消費者 group Which?, says: 'Aviva is getting away with a number of 乱用s here, but that is 簡単に because the FSA 許すs it to.'

There are 850,000 適格の policyholders and they have until the end of the month to return 投票(する) papers which they should have already received.

Only 投票(する)ing in favour of the reattribution will 誘発する/引き起こす a windfall. Not 投票(する)ing - or 投票(する)ing against - will mean no 即座の windfall, but those who 投票(する) no or do not 投票(する) will 保持する the 権利 to 利益 from any possible 利益(をあげる)s arising in 未来 from the cash pile.
